TUC: Government must end its cruel assault on sick and disabled people

The latest government announcement on reforms to financial support for those with ill health or disability is misleading rhetoric. The lives of those with ill health or disability are completely misrepresented, and the language they use is divisive, (writes TUC’s ANJUM KLAIR).

Mel Stride announced the consultation on reform of Personal Independent Payments (PIP). Two immediate observations from us are:   

  • The Government has deliberately confused the purpose of this benefit in order to ramp up its benefit scrounger rhetoric. PIP is not an out-of-work benefit: disabled people in full-time employment can be, and are, assessed as eligible for PIP. It assesses whether someone’s impairment or health conditions affects their day-to-day life and is intended to cover some of the additional costs incurred as a result of being disabled. It is not for assessing if you are capable of work- or work-related activity.  
  • The idea that you can claim PIP for mild mental illness is untrue. The criteria for accessing PIP is stringent. You have to be suffering from severe mental illness. It is a complex application process and have to provide medical evidence. 

If the current data is showing rising numbers of those with severe depression and anxiety claiming PIP, you don’t change the eligibility criteria to reduce claimant numbers – you look at the underlying drivers of ill health.    

More than a decade of austerity under the Conservatives has resulted in crumbling public services. 

NHS waiting lists are at record highsfood insecurity and destitution has increased, and poverty levels are rising. This will inevitably affect physical and mental health. Data shows life expectancy and healthy life expectancy falling, and this is more profound in deprived areas.      

The approach by government is to blame individuals. Only recently the Prime Minister attacked those too sick to work, by saying UK had a sick note culture, yet the data on workplace sickness absence does not suggest any substantial challenges.

And again, government conflates two separate areas, sick notes look at short-term illness for those in work and not long-term illness and disability.  It is the rise in long-term sickness and disability which is alarming.  

The ideas proposed in the consultation also include the insulting suggestion that disabled people are not to be trusted with spending their benefits on essential support. As it moves away from a fixed cash benefit and proposes to reimburse for extra costs, this also assumes that disabled people have the money to pay up front for this.

The consultation also proposes accessing treatments rather than receiving benefits for ill health, yet it is the lack of access to treatment which is exacerbating the increase in ill health.  The long delays are well documented. Just for mental health support there is around1.9 million people waiting for support in England,        

The PIP consultation also adds a further layer of confusion for people not working due to ill health, as the government already set out a plan for health and disability benefits reform last year.  This is proposed for the new Parliament, and includes:    

  • The Work Capability Assessment (WCA) to be abolished and eligibility for the health top-up in Universal Credit (UC) ( in this case the health element) will be passported (i.e. approved) via PIP.  
  • The current UC Limited Capability for Work and Work-Related Activity (LCWRA) element will be replaced with a new UC health element.  
  • Introduce more tailored conversations for claimants with work coaches, to enter suitable employment.  

While we have issues with the validity of WCA decisions, it is supposed to assess people’s ability to work, while PIP clearly does not do this. This proposed change would amount to a huge financial cut to those not well enough to work. The IFS estimates that one million disabled or seriously unwell people who can’t get PIP would lose out by £350 a month. 

Wider problems in the Government’s plan include the proposed introduction of a new personalised health conditionality approach. Disabled people will also face a higher risk of sanctions, as at present people currently identified as being unable to work and prepare for work are protected but could lose this right under the changes.   

Such measures do not consider the structural barriers that stop disabled people from entering into the workplace, such as discrimination from employers, a failure to put in place reasonable adjustments, and inaccessible transport. The result will be many disabled people whose health makes it difficult or impossible to carry out work activity without a realistic chance of getting a job, being threatened with sanctions. 

Separately the Government has made changes to descriptors in the WCA to apply from September 2025 for new claimants. As a result, 424,000 fewer people are expected to be assessed as having limited capability for work and work-related activity by 2028 to 2029.

The theme by the Conservative government is to constantly reduce eligibility to cut social security entitlement for disabled people or those with ill health. Government needs to end this cruel assault on sick and disabled people.  

Police Scotland’s latest canine recruits – Digital Evidence Detection Dogs

The latest additions to Police Scotland’s canine search capability – Digital Evidence Detection Dogs – are currently being trained before they are deployed operationally.

The dogs will assist officers investigating a crime where a digital device, such as a smartphone, tablet and laptop, may have been used and is believed to have been hidden.

The trainee dogs – Zen, a rescue Springer Spaniel, Xena, a Springer Spaniel/Labrador cross, Max a Sprocker, gifted by the previous owners who wanted him to have an active home, Pip, a Malinois/Australian Shepherd Cross, gifted by a member of the public and Willow, a Labrador – and their three specialist handlers are a national resource.

When their specialist training is complete they will be able to detect hidden devices and hardware which existing searches may not be able to identify.

Assistant Chief Constable Andy Freeburn said: “It is now extremely common for a digital device to be used in criminal activity, which is then concealed by the perpetrator to hide incriminating evidence.

“People and businesses are spending more and more time online and criminals will use any means available to them to exploit vulnerabilities and any method at their disposal. Digital devices are becoming smaller in size and those involved in criminal activity are becoming more adept at hiding them.

“Searches by humans can be limited and the dogs will provide an additional capability which make finding hidden devices easier.

“Police Scotland is committed to keeping everyone safe and this addition to our search capabilities will ensure there is no hiding place for criminals, even in the digital world.”

“The training of the dogs takes between six and eight weeks and when complete they will be an invaluable resource to assist our officers and staff search for evidence.”

The Digital Evidence Detection Dogs search capability is an additional resource and complementary to Police Scotland’s existing canine resources including those dogs that can currently search for drugs, explosives, cash, firearms, human remains and blood.

In December 2023, Benjamin Young from Dunoon was convicted of serious sexual offences against children.

For the first time in Scotland, a Digital Evidence Detection Dog, deployed from another force, assisted during the investigation by carrying out searches which located several SIM cards.

Last week Young was sentenced to 12 years in prison and had an Order of Lifelong Restriction imposed.

Benefits health assessments system continues to let people down, say MPs

The health assessments system to access vital benefits for those who cannot work or face extra costs due to disability or ill-health continues to let down those who rely on it, according to Westminster’s Work and Pensions Committee.

In its latest Report, the Committee calls for the implementation of several measures that would be relatively quick and easy wins to improve trust, drive down the high rate of decisions reversed on appeal and reduce waiting times.

It says assessments should be recorded by default, with claimants having the option to opt-out, adding that footage could be used to review cases more accurately without having to go to appeal, and help assessors learn from past mistakes.

Some of the improvements the Committee suggest could drive down the high rate of decisions reversed on appeal, which still stands at 69% for Personal Independence Payment (PIP). Although the Work Capability Assessment used for Universal Credit and Employment and Support Allowance is due to be abolished, it will remain in place until at least 2026. Meanwhile, PIP assessments will continue, so retaining the status quo is not an option.

MPs on the Committee also recommended allowing claimants to choose between remote or in-person assessments, extending the deadline to return forms, targets to reduce assessment waiting times, and payments to people who have been forced to wait beyond the new targets.

The predecessor Committee originally published a report on significant problems in assessments in 2018, but many of the recommended changes have not been made.

Committee Chair Sir Stephen Timms MP said: ““We surveyed eight and a half thousand people as part of our inquiry and found a profound lack of trust in the system as a consistent theme.

“Many will welcome abolition of the Work Capability Assessment.  The Government’s process improvements, and recognition that the system causes undue stress and hardship, are steps in the right direction.

“However, waiting years for changes won’t cut it when quicker wins are available:  flexibility of choice on assessment by phone or face-to-face; recording assessments by default; extending deadlines to reduce stress; and sending claimants their reports. All this will give much-needed transparency to a process that so few trust yet affects their lives so fundamentally.

“All efforts must be made for unnecessary limbo and stress for claimants to be put to an end.”

2022 biggest year yet for Scottish social security system

 The introduction of Adult Disability Payment, further automation and the increase and extension of Scottish Child Payment has seen more people apply for and get financial support they are entitled to.

Thousands of people have also had their benefit awards transferred to Social Security Scotland from the Department of Work and Pensions.

In March, Adult Disability Payment, which replaces the UK Government’s Personal Independence Payment and is the most complex benefit to be introduced so far, was launched as a pilot project before being made available to eligible disabled adults aged 16 to state pension age in Scotland at the end of August.

In November, Scottish Child Payment increased to £25 and was extended to include eligible children up to age 16 and around 385,000 children are now expected to be eligible.

At the same time, Social Security Scotland introduced further automation. Families and carers who already get Scottish Child Payment will now automatically be paid Best Start Grant Early Learning and School Age payments when their child is eligible.

Automatic payments continued for around 90,000 carers eligible for the December payment of Carers Allowance Supplement, as well as around 23,000 disabled children and young people who received Child Winter Heating Assistance to help heat their homes.

Minister for Social Security Ben Macpherson said: “There is no doubt that 2022 has been the biggest and most complex year yet for Social Security Scotland. Creating a new social security system at pace has not been a simple task, but the progress made since 2018 has been substantial.

“Introducing Adult Disability Payment to replace the DWP’s Personal Independence Payment was a significant milestone in the growth of the Scottish social security system and marked a step change, delivering an improved experience for disabled people that is compassionate and rooted in trust.

“With many people facing financial hardship during the ongoing cost of living crisis, extending the Scottish Child Payment to under 16 year olds means that now hundreds of thousands more children will get much needed extra financial support.

“Investing in social security is a priority for the Scottish Government. Our commitment in the 2023-24 Budget to uprate benefits by 10.1% will mean more support going to people on low-incomes, disabled people, carers and young people right across Scotland at a time when many are facing tough financial challenges.

“Though there is still much work to do, we are creating a system to be proud of  and building strong foundations to serve Scotland for generations to come, treating people with dignity, fairness and respect. Social security is a human right and an investment in creating a fairer society, together.”

Dad Martin, whose daughter has learning difficulties, says receiving benefits helped his daughter flourish.

He said: “I went on the website and applied for Child Disability Payment. When I got accepted I went from having nothing at the end of the month to having £97 left. This enabled me to do so many things with my daughter and because of that she has flourished.”

Another young woman who received the Young Carer’s Grant this year, said: “It had a positive impact because I needed new clothes so I spent about £100 on clothes and then I shared the rest of the grant with my brother and sister.”

A mum who received School Age Payment for their child said: “I applied for this grant for my child when she started primary one. It was a great help to us to cover the costs of school uniforms and accessories required for school. I would urge all parents to apply for this grant.”

Dignity, fairness, respect: Improving disability benefits

Disabled people with the most serious lifelong health conditions will have more financial security under Scotland’s social security system.

Adult Disability Payment will replace the UK Government’s Personal Independence Payment (PIP). It will open for new applications in pilot areas starting this month.

Disabled people on the highest components of the new benefit and whose needs are highly unlikely to change will be eligible for an “indefinite award”. In effect, this will mean they will not be subject to reviews and can rely on their new benefit into the long-term.

People with ongoing awards of Personal Independence Payment and Disability Living Allowance do not need to make an application for Adult Disability Payment. They will be contacted from this summer to let them know when their awards will automatically be moved safely and securely to Adult Disability Payment.

Social Security Minister Ben Macpherson said: “The introduction of indefinite awards, as part of Adult Disability Payment, underlines our commitment to deliver on the principles of Scotland’s social security system to treat people with dignity, fairness and respect.

“In making this decision, we have engaged with a wide range of people with lived experience of the current system and will continue to listen as we design and build a social security system that works for disabled people.

“We want to ensure that people on the highest levels of Adult Disability Payment awards receive long-term and adequate support, because those with lifelong conditions, or disabilities resulting in needs highly unlikely to change, should not be subject to unnecessary reviews when it is reasonably expected that their situation will not change.

“Under the UK Government’s Personal Independence Payment, similar awards have generally been reviewed between every 2 to 10 years. However, disabled people tell us that even review periods of 10 years can create stress and anxiety. That is why we have decided to introduce indefinite awards – we are determined to do things differently and build a more compassionate system in Scotland.”

Moira Tasker, Chief Officer, Inclusion Scotland said: “Inclusion Scotland warmly welcomes the announcement that there will be indefinite awards of Adult Disability Payment. We are glad the Minister has acted on the views expressed by disabled people and adopted this measure.

“It will come as a huge relief for disabled people with high, permanent levels of impairment who faced continual reassessments under the flawed DWP, Personal Independent Payment, system. Indefinite awards will also provide some certainty and security for those who receive them.”

Morna Simpkins, Director of MS Society Scotland, added: “We are pleased the Scottish Government has listened to the views of the MS community and MS Society Scotland and will re-introduce indefinite awards.

“MS is relentless, painful, and disabling. Indefinite awards will provide some people living with progressive long term conditions, like MS, with the security of knowing they will not have their awards downgraded or income cut.”

Adult Disability Payment is the twelfth benefit to be introduced by Social Security Scotland since September 2018, which includes seven new benefits, unique to Scotland.

First Minister announces 2,000 jobs at Social Security Scotland

More than 2,000 jobs will be created with Social Security Scotland over the next 12 months, First Minister Nicola Sturgeon has announced.

Recruitment will start in October for staff to support the delivery of benefits due to be introduced next year, including the Adult Disability Payment – the Scottish Government’s replacement for the Personal Independence Payment.

The majority of the new roles will be based in Social Security Scotland’s Dundee head office and Glasgow, to take calls from clients and process applications for Scottish benefits.

The remainder will be based across the country to provide face-to-face advice for people applying in the way that would suit them best, whether that is online, by phone, by post or in person.

The First Minister said: “Social security is a human right and a collective investment in the people of this country now and for future generations.

“These roles come at a critical time in Scotland’s recovery from the COVID-19 pandemic and our investment will go beyond the money that we will pay in benefits. When we have introduced all our new benefits and moved clients from the DWP to Social Security Scotland, our new social security service will employ more than 3,500 people. This will provide secure, long-term employment in Dundee, Glasgow and across the country and deliver a positive economic impact of £280 million for our economy.

“We are committed to creating a diverse workforce to provide this public service. Having people from a wide range of backgrounds will help deliver the best service and ensure that we do things differently and treat people with dignity, fairness and respect.”

Sixteen year old Scots won’t face PIP ordeal

The Scottish Government will use its new benefits powers to remove the need for children to take part in Department for Work and Pensions (DWP) Personal Independence Payment (PIP) assessments.

Under current DWP rules, children getting Disability Living Allowance for Children are asked to apply for PIP six months out from their 16 birthday, but under the Scottish Government changes, young people will continue to get DLA Child, as long as they remain eligible, up to the age of 18.

This means that they will not need to do a DWP PIP application or assessment – which many people say are stressful.

The change comes as the Scottish Government takes full responsibility for disability benefits from April this year.

Social Security Secretary Shirley Anne Somerville said: “We know from people like June Jamieson, a parent who has had direct experience of the current system, that making the transition from child to adult services can be a challenging time for their child and family.

“Adding to this, young people may be going through changes in a number of other areas of their life at the same time. We’ve also been told that the fact that this transition is to PIP, creates even more stress and anxiety.

“This is why we are using our new social security powers to extend the eligibility,  ease the pressure on families and make sure young people in Scotland have adequate time to move from children to adult social security support.

“Our priority for people already getting this support from the DWP is to move them over in a safe and secure way and make sure that people get the financial support they expect, when and where they expect it.”

Ms Jamieson, from Edinburgh, has recently applied for PIP for her son Alex, who turned 16 in January. She said: “So many things are happening in a child with additional needs life when they turn 16, for example they need to think if they are staying on at school, and parents may need to apply for guardianship.

“It will really take the pressure off lots of other families not to have to worry about this. Although Alex won’t benefit from the changes I am really pleased that other people will. I have the fear of the unknown waiting to hear the outcome of his PIP application.”

Disabled campaigners take action across Scotland

Disabled campaigners will be protesting at the Scottish Parliament in Edinburgh, a disability benefits centre in Glasgow and in City Square, Dundee tomorrow as part of a UK-wide day of action against disability benefit changes.

Protests will be held at many assessment centres run by Atos and Capita, the private companies who hold contracts with the Department for Work and Pensions to test disabled people’s eligibility for the Personal Independence Payment benefit.  Continue reading Rotten to the core!

Lazarowicz: Fast-track benefits for terminally ill

Mark Lazarowicz MP is backing Gordon Aikman’s MND campaign and has called on the Government to fast track benefits for people like Gordon with terminal conditions.

Speaking in a debate in Parliament yesterday, the Labour MP for Edinburgh North and Leith called on the Government to fast track benefit claims from people with terminal conditions like Motor Neurone Disease and intervened to tell the Minister that the prolonged delays, in some cases of up to 18 months, could mean the outcome comes too late for some people with limited life expectancy.

He said later: “I strongly support Gordon Aikman’s campaign to fast track benefit claims from people with terminal conditions like MND: people are waiting 6 months and in some cases 3 times that just to have an assessment.

“Claims can be fast tracked where someone is not expected to live longer than 6 months but where does that leave someone with MND where the average life expectancy after diagnosis is 14 months?

“The Government should offer financial support to people suffering as a result of the delays caused by its own incompetence but first and foremost it should make sure that their claims are fast tracked.

“The Minister’s response in the debate was not acceptable: it’s shameful that people who are so ill should spend the last months or year of their life in financial hardship having to fight so hard for the benefits they are entitled to.”

He was speaking in a debate on the introduction of the new Personal Independence Payment (PIP), the disability benefit that is replacing Disability Living Allowance (DLA) which is designed to help seriously ill or disabled people with the extra costs their condition entails.

It was announced on Thursday that responsibility for PIP is to be devolved in future and Mark has called for the roll-out of the new benefit to existing DLA claimants to be stopped until it is because of the huge backlog of assessments.

That was also the conclusion of the House of Commons Work and Pensions Select Committee: it reported last March that even where someone did have their claim fast tracked because they were not expected to live more than 6 months, the time taken to process their claim had increased from typically 8 days with DLA to 8 weeks with PIP.

Mark Lazarowicz says the Government has moved the goalposts: its original target was for the whole process from claim to decision to be completed within 16 weeks, now it is that all assessments should be completed within that time and it is even failing that target.
