Joint call for mandatory ethnicity pay gap reporting

The TUC, CBI and Equality and Human Rights Commission (EHRC) yesterday issued a joint call for the government to introduce mandatory ethnicity pay gap reporting. 

In a joint letter to the Chancellor of the Duchy of Lancaster, Michael Gove, the heads of the three organisations say: “Introducing mandatory pay reporting on ethnicity would transform our understanding of race inequality at work and most importantly, drive action to tackle it where we find it.” 

The letter – signed by TUC General Secretary Frances O’Grady, CBI Director General Tony Danker and EHRC chairwoman Baroness Kishwer Falkner – urges ministers to set out a clear timeframe for introducing ethnicity pay gap reporting to help “ethnic minorities reach their full potential in the workplace.” 

TUC General Secretary  Frances O’Grady  said:  “Everyone deserves the chance to thrive at work, and to have a decent, secure job they can build a life on. But the sad reality is that even today race still plays a significant role in determining people’s pay and career progression. 

“This problem isn’t going to magic itself away. Without robust and urgent action many BME workers will continue to be held back. 

“Unions stand ready to work with employers, regulators and government on practical steps to tackle inequality and discrimination in the workplace. 

“Mandatory ethnicity pay gap reporting is an obvious first step in helping to improve transparency and bring about change. 

“We need ministers to commit to introducing ethnicity pay reporting now and to bring forward a clear timetable for getting it into law.”

The case for mandatory ethnicity pay reporting 

We are writing to set out our shared priorities to the inter-ministerial group established to consider the recommendations of the Commission on Race and Ethnic Disparities. Respectively, we represent millions of workers, thousands of businesses, and enforce the Equality Act 2010 in Britain to ensure that people have equal access to and are treated fairly at work. 

We agree with the Commission’s statement that the report comes at a pivotal moment for the country, at a time when the inequalities facing ethnic minority people are under scrutiny. Outcomes at work are no exception. However we believe the report’s recommendations, in particular those related to pay disparities, could go further in order to effectively increase the participation and progression of ethnic minorities in the workplace and create a fairer Britain. 

Introducing mandatory pay reporting on ethnicity would transform our understanding of race inequality at work and most importantly, drive action to tackle it where we find it. This has been a longstanding goal for all of us. It will enable employers to identify, consider and address the particular barriers facing ethnic minorities in their workplace, and will complement and enhance the work many already do to address gender pay gaps under existing regulations. 

Together we’re asking the Government to make it mandatory for employers to report on their ethnicity pay gaps, building on the successful framework already in place for gender. Reporting, done well, can provide a real foundation to better understand and address the factors contributing to pay disparities. To further enable this, we also support the Commission’s recommendation that pay gap data should be supported by a narrative – comprised of key data, relevant findings and actions plans to address race inequalities. 

Some employers are already voluntarily reporting on their ethnicity data and taking action to address race inequality in their workplaces. While this is welcome and should continue to be supported in the interim, introducing mandatory ethnicity pay reporting will put greater focus on race at work, contribute to a greater number of employers reporting their ethnicity pay gap figures, and achieve the change across the labour market that is required. 

We urge Government to set out a clear timeframe to implement this and encourage you to work with us to develop the tools and resources required to ensure that employers are supported, and that workers are confident in disclosing data in advance of making reporting mandatory. 

In so doing, we firmly believe that this will help ethnic minorities reach their full potential in the workplace, make business more inclusive, and ensure Government has a rich source of robust evidence to inform future labour market and industrial strategies.

Macaroon Cake with Mixed Berries 

The perfect serve for guests during the Wimbledon final weekend 
 
Fed up with sponge cakes? Why not try this moreish meringue cake flavoured with ground almonds and toffee flavoured muscovado sugar and luxuriously filled with ruby summer berries and whipped cream.  

Serves 6 

Preparation time 30 minutes 

Cooking time 35-40 minutes 

4 medium egg whites 

¼ tsp cream of tartar 

150g/5oz caster sugar 

75g/3oz light muscovado sugar 

1 tsp white wine vinegar 

50g/2oz ground almonds 

For the filling 

250ml/8fl oz double cream 

150g/5oz Greek yogurt 

350g/12oz AVA strawberries, sliced 

100g/4oz raspberries 

50g/2oz blueberries 
 

1.     Whisk the egg whites and cream of tartar in a large bowl with an electric whisk until stiff but still moist looking peaks. Gradually whisk in the caster sugar, then muscovado sugar, a teaspoonful at a time until they have all been added, whisk for a minute of two more until the mixture is thick and glossy.  

2.     Fold in the vinegar and ground almonds with a large metal spoon then divide the mixture between two, lightly oiled 20cm/8in sandwich tins that have been base lined with a circle of non-stick baking paper.  

3.     Bake in a preheated oven set to 150°C/gas mark 2 for 35-40 minutes until lightly browned and crisp. Loosen the edges of the cakes carefully with a knife then leave to cool in the tins.  

4.     Loosen the edges of the cakes once more then turn out on to a sheet of non-stick baking paper. Peel off the paper from the bases.  

5.     Whip the cream until if forms soft swirls, then fold in the yogurt. Transfer one macaroon cake to a serving plate, spread with two thirds of the cream mixture. Arrange two thirds of the fruit on top then add the second macaroon cake. Decorate the top with the remaining cream and berries and serve within 30 minutes of assembly.  

Cook’s tip 

The macaroon cake can be made the day before and then turned out on to a tray lined with non-stick baking paper. Cover with a second sheet of paper and store in a cool dry place. The cakes are very fragile so handle with care, you may find it easier to transfer them to a serving plate by sliding the base of a loose bottomed cake tin underneath them rather than using a palette knife or fish slice. Decorate with cream and summer fruit at the very last minute.  

AVA Strawberry trifle with Pimms 

Who can resist trifle? This lighter more modern version is made with Pimms soaked strawberries and topped with reduced fat custard and a lighter, reduced fat creamy yogurt layer flecked with citrusy lemon and orange rind. If you have time leave the strawberries and Pimms to soak for 30 minutes or more so that the flavours seep into the sponge base before topping with the custard and cream.   

Serves 6 

Preparation time 25 minutes 

Chilling time 2 hours 

4 trifle sponges, about 100g/4oz in total 

350g/12oz AVA strawberries, sliced 

4 tbsp caster sugar 

4 tbsp Pimms, undiluted 

425g/15oz can reduced fat custard 

200ml/7fl oz double cream 

150g/5oz low fat natural yogurt 

Grated rind half orange 

Grated rind half lemon 

To decorate 

3 AVA strawberries, halved lemon and orange rind. 

1.     Break the trifle sponges into pieces and arrange in a single layer in the base of a 1.2 litre/2 pint glass dish. Arrange the strawberries on top, sprinkle with 2 tbsp sugar then spoon over the Pimms.  
 

2.     Spoon the custard over the top of the fruit and spread the top into an even layer.  
 

3.     Whip the cream in a bowl until it just forms soft swirls then fold in the yogurt and fruit rinds. Spoon over the custard and chill until required. Decorate with halved strawberries and lemon and orange rind curls made with a zester just before serving.  

AVA Strawberry and Raspberry Ripple Eton Mess 

Make up the AVA strawberry swirled meringues and fruit puree the day before, then just layer with whipped cream and extra fruit in recycled jam jars and screw on the lids, take out to the garden in a basket or pack into a cool box for a picnic pud.  

Serves 6 

Preparation time: 35 minutes 
Cooking time: 1¼ -1½ hours 

225g (8oz) AVA strawberries, hulled 
100g (4oz) raspberries 

Meringues 
2 egg whites 
100g (4oz) caster sugar 

To finish 
300ml (1/2 pint) double cream 
200g (7oz) 0.1% fat fromage frais 
225g (8oz) strawberries, hulled, roughly chopped 
50g (2oz) raspberries 

1.     Preheat the oven to 110°C (225°F), Gas Mark ¼. Line a large baking sheet with non-stick baking paper.  

2.     Puree the strawberries and raspberries in a liquidiser or food processor then press through a sieve.  

3.     Whisk the egg whites in a large clean dry bowl until they form stiff moist looking peaks and you feel confident that if the bowl was turned upside down the egg whites wouldn’t fall out! Gradually whisk in the sugar a teaspoonful at a time then continue whisking for a minute or two until really thick and glossy.  

4.     Add 2 tablespoons of the berry puree then very briefly mix until marbled. Spoon into a large piping bag fitted with a 1.5cm (¾ inch) plain piping tube, pipe small rounds on to the lined baking sheet. Bake for 1¼  -1½  hours or until the meringues may be easily lifted off the paper. Leave to cool.  

5.     To serve, lightly whip the cream until it forms soft swirls then fold in the fromage frais. Crumble the meringues then layer in jam jars or plastic containers with the remaining berry puree and diced strawberries. Decorate with the raspberries.  Add the lids and keep in the fridge until ready to serve or transport to a picnic in a cool bag with a frozen ice block to keep them cold. Serve within 1½ hours or the meringues tend to lose their crunch. 

Supporting care-experienced young people

The Promise Partnership Fund extended

A £4 million per year fund to help improve the lives of care-experienced young people will continue up to 2024-25.

The Promise Partnership Fund enables organisations to better support children and young people in or on the edges of care, as well as families who need it.

The fund is open to private, public and third sector organisations and care-experienced people will help make the final funding decisions.

Deputy First Minister John Swinney has also welcomed publication of The Change Programme, which sets out what needs to happen over the next year to ensure Scotland keeps its Promise to improve the lives of children and young people in care.

Mr Swinney said: “The Promise Partnership Fund is an important because it provides additional resources to help organisations make the changes needed to enrich the lives of children and young people in or on the edges care.

“I have written today to Fiona Duncan, chair of The Promise Scotland, welcoming publication of The Change Programme and committing to using that document as a lever to accelerate real and meaningful change to #KeepThePromise.

“We will continue to work with The Promise Scotland, with service partners and importantly children and families to ensure we drive forward the transformational change that is required to make Scotland the best place to grow up where all children are loved, safe, respected and realise their full potential.”

The Promise Scotland publishes Change Programme ONE

Today The Promise Scotland publishes Change Programme ONE. It is a plan of action for the coming year and follows on from the publication of Plan 21-24 which mapped and sequenced the 80+ calls to action in the Independent Care Review’s conclusions and identified five priority areas for the coming three years.

The collective buy-in to the change demanded by the Independent Care Review created an authorising environment for this approach to sequenced, collaborative implementation across multiple sectors and agencies towards a single, shared long-term vision.

This is new territory for Scotland.

The content of the Change Programme comes from the engagement The Promise Scotland is having with the organisations that have responsibility to change shape first or most for Scotland to #KeepThePromise.  They are referred to in the Change Programme as ‘lead organisations’. 

Many of the meetings to discuss the promise included multiple agencies, reflecting the joint working taking place across local partnerships to support children and families, demonstrating a sustained, shared commitment for doing things differently.  The focus of the conversation was: what is happening now, what is planned and what is getting in the way of progress.

The Promise Scotland has made an assessment of the work against three categories. In nine areas, work is underway; in fifteen areas work is underway but does not yet appear sufficient; and in one area there is little or no work underway.

This is the first Change Programme and it was produced in the shadow of COVID-19, but it clearly shows there is a lot to do. The Promise Scotland Oversight Board will consider it, review mismatch and lack of alignment between national and local, system and service, practice and culture, etc.

This is the tricky part. When folk have to stop saying they support change and ACTUALLY change.

Some may feel criticised by the Change Programme, bruised by their report card. Others would like to have been more involved in its creation, but for them to operate radically differently commissioning, policy etc. has to change.  And others saying they are doing what they can but the limitations of the operating environment won’t let them do more. The Oversight Board has to consider all of this.

Navigating this new territory has never been more important.

Many of the children and families who weren’t previously well served by public services have been the hardest hit over the last fifteen months, feeling even more acutely the effects of poverty, abuse and neglect, the impact of poor housing, the challenges of loneliness and addiction.  And suffering the greatest loss of life.

The pandemic intensified, but did not create poverty and trauma.  These families, as well as many others who were previously coping but due to changes in circumstances outwith their control, may now need help. So too might the thousands of new parents, as COVID-19 chronically restricted their access to social and professional support networks.

A profound risk of these consequences is that more children enter Scotland’s ‘care system,’ when, with support, families could stay together and thrive. They cannot be fearful of asking for help and it must be there when they need it.

The long-term impact of the last year on our children and young people is, as yet, unknown. Not being able to get out to play with friends or see family, instead worrying about loved ones whilst trying to keep up with schoolwork, sometimes without the kit needed to learn and in accommodation not conducive to learning, has been devastating. There have been too many lost opportunities to take part in activities like sport, music, art, sleepovers, with volunteering and work experience placements vanishing.

But here’s a difficult truth: those circumstances are not far from the everyday, pre-pandemic reality of children and young people who experience the very worst of Scotland’s ‘care system’. Eighteen months on from the Care Review there is no excuse for that ‘care system’ not to be gone for good.

The Change Programme is not an exhaustive list of all that is happening across Scotland. Everyday people and organisations are supporting children and families, caring for the children in Scotland’s care, championing their rights and helping make sure they go on to have a fulfilling life. They are doing what they can right now.

So, when you read it – and I hope you do – please think about your role, your responsibility and do what you can. Today, tomorrow and everyday.

We are more likely to get to where we all want to if we travel together and towards the same vision.

Change Programme One is live!

On 31 March 2021, The Promise Scotland published Plan 21-24, the first of three overarching plans, outlining five priority areas of change, each with actions.

Those actions must be completed by 2024 for Scotland to stay on track to #KeepThePromise it made to its children and families, in full, by 2030.

The Change Programme will ensure these actions are taken. Between now and 2024, a Change Programme will be updated regularly to capture the work underway to #KeepThePromise, in each priority area of change.

It will record change as it happens, monitor progress, identify gaps and risks. Change Programme One tells us:

  • What is happening now
  • What is happening next &
  • What needs to happen

Change Programme One will be used to:

  • Identify, celebrate and amplify positive change
  • Link up siloed groups, services and individuals so they can work together
  • Provide extra support to organisations that need it

By March 2022 The Change Programme will be fully online, reflecting change in (as close as possible to) real time, providing a single window onto the cross-sector, multi-agency approach to collaborative implementation that is required.

Change Programme ONE is a live plan of actions that will constantly adapt and change over time and when needed, to best #KeepThePromise.

The Change Programme includes commitments made by organisations from all across Scotland, reflecting what they are doing differently, based on what matters most to children and families.

CMA to investigate Amazon and Google over fake reviews

The CMA has opened a formal probe into Amazon and Google over concerns that they have not been doing enough to combat fake reviews on their sites.

In this next phase of the work, the Competititon and Markets Authority (CMA) will gather further information to determine whether these two firms may have broken consumer law by taking insufficient action to protect shoppers from fake reviews.

The move comes after an initial CMA investigation, which opened in May 2020, and assessed several platforms’ internal systems and processes for identifying and dealing with fake reviews.

This work has raised specific concerns such as whether Amazon and Google have been doing enough to:

  • Detect fake and misleading reviews or suspicious patterns of behaviour. For example, where the same users have reviewed the same range of products or businesses at similar times to each other and there is no connection between those products or businesses – or where the review suggests that the reviewer has received a payment or other incentive to write a positive review.
  • Investigate and, where necessary, remove promptly fake and misleading reviews from their platforms.
  • Impose adequate sanctions on reviewers or businesses to deter them and others from posting fake or misleading reviews on their platforms – including those who have published these types of reviews many times.

The CMA is also concerned that Amazon’s systems have been failing adequately to prevent and deter some sellers from manipulating product listings – for example, by co-opting positive reviews from other products.

Fake and misleading reviews have the potential to impact on businesses’ star ratings and how prominently companies and products are displayed to consumers, changing their whole shopping experience.

Andrea Coscelli, the CMA’s Chief Executive, said: “Our worry is that millions of online shoppers could be misled by reading fake reviews and then spending their money based on those recommendations. Equally, it’s simply not fair if some businesses can fake 5-star reviews to give their products or services the most prominence, while law-abiding businesses lose out.

“We are investigating concerns that Amazon and Google have not been doing enough to prevent or remove fake reviews to protect customers and honest businesses. It’s important that these tech platforms take responsibility and we stand ready to take action if we find that they are not doing enough.”

If, after investigating, the CMA considers the firms have broken consumer protection law, it can take enforcement action. This could include securing formal commitments from the firms to change the way they deal with fake reviews or escalating to court action if needed. However, the CMA has not reached a view on whether Amazon and Google have broken the law at this stage.

This latest work builds on action taken by the CMA last year over the trading of fake reviews, which resulted in Facebook, Instagram and eBay removing groups and banning individuals for buying and selling fake reviews on their sites.

The CMA’s investigation into fake reviews is part of a broader programme of CMA work, which includes establishing a new pro-competition regulatory regime for digital markets, to curb the power of big tech. This will be achieved through the Digital Markets Unit. As the CMA works with the Government on proposals, it will continue to use its existing powers to their fullest extent in order to examine and protect competition in these areas.

Rocio Concha, Which? Director of Policy and Advocacy, said: “We have repeatedly exposed fake reviews on websites including Amazon and Google, so this investigation is a positive step. The CMA must now move swiftly towards establishing whether these companies have broken the law.

“This should prompt Amazon and Google to finally take the necessary steps to protect users from the growing tide of fake reviews on their platforms and, if they fail to do so, the regulator must be prepared to take strong enforcement action.

“The government must also give online platforms greater legal responsibility for tackling fake and fraudulent content on their sites – including fake and misleading review activity.”

NHS Lothian trials new technology to help manage COPD symptoms

A new tool to help patients with Chronic obstructive pulmonary disease (COPD) better manage their condition is being trialled by NHS Lothian’s Midlothian Community Respiratory Team (MCRT) in collaboration with Health Innovation South East Scotland.

COPD affects approximately 120,000 people in Scotland and is the second most common reason for emergency hospital admissions.

The Dynamic Scot project (remote physiological monitoring) allows patients to monitor their condition from the comfort of their own home through a digital service that can be accessed via a smartphone, tablet or computer.

Patients are prompted each day to log on and answer questions about their symptoms and how they are feeling. This encourages them to self-manage their symptoms with the option to seek advice when needed via the messaging service. In the longer term this can flag up early signs of deterioration in their condition and help predict if they are at risk of hospitalisation.

Claire Yerramasu, Advance Practitioner Physiotherapist and lead clinician for the MCRT pilot, NHS Lothian (above) said, “COPD is the third most common cause of mortality world-wide and is a major healthcare problem.

“The prevalence of this condition is rising in the UK along with other parts of the world and we therefore need to come up with innovative ways of ‎better monitoring and supporting these patients.

“So far, I have received nothing but positive feedback from the patients currently trialling this new technology.”

Carmel Thompson, one of the patients in the trial said: “Using the online tool makes me think about the variability of my daily symptoms and how I am managing them and because of this I am more confident to wait longer to see if my symptoms resolve before using my rescue medications.

“The service gives a good level of basic information for those who are willing to engage with it and the daily questions are very easy for me to do routinely in the morning.”

Another patient also trialling the new tool, Charlotte Sweeney explained that, “I have found the service useful for recognising my symptoms and knowing what to do and when. It is reassuring to have the messaging service to be able to contact someone with questions and queries.”

Many health services have changed how they work as a direct result of the COVID-19 pandemic and have experimented with digital platforms. Through this approach, a whole host of benefits have been experienced including  giving patients back more control of their care, allowing them to fit their healthcare needs around their lifestyle and reducing the amount of time that they need to spend travelling to attend hospital appointments.

Dr Gourab Choudhury, Consultant Physician, Respiratory Medicine in NHS Lothian said: “We are delighted to be trialling this technology here in Lothian. It is simple to use and patient friendly and the feedback that we have had so far has been really positive.

“We hope to further expand the role of virtual platforms to other areas in Lothian through this technology and similar others in the coming months.”

Pride Month: Childline reports rise in counselling sessions about gender identity and sexuality

The NSPCC’s Childline has delivered 305 counselling sessions to young people in Scotland about gender identity and sexuality in the past year.

In more than 170 of these counselling sessions, young people mentioned coming out as a concern – an 11% increase from the previous year.

The children’s charity has released this data to mark Pride Month. Childline currently has around 370 volunteer counsellors, across its Glasgow and Aberdeen bases, who have heard first-hand how tough the past year has been for many children and young people due to challenges posed by the Coronavirus pandemic. Many have struggled with local lockdowns and being cut off from their usual support networks, while others have been worried about returning to school.

However, some young people described the lockdown as a time of reflection and a chance to take stock, and finding confidence to come out to their friends and family. Some also talked about feeling worried about the reaction they would get from other people.

A young person who spoke to Childline said: “I want to tell somebody that I’m gay but I just can’t find the courage to. I don’t want people to judge me or treat me any differently if they find out. Some people really hate gay people and I’m scared of what will happen if I tell someone”. (Girl, aged 12)

As restrictions continue to ease, it remains vital that all children and young people know where they can access help and support.

This Pride Month, Childline reminds young people that the service is here for them. All children can speak to a trained volunteer counsellor over the phone, via email or on a one-to-one chat on the Childline website.

The NSPCC also has information on it’s website for parents and carers on how to talk to children about their sexuality and advice on how to help keep them safe.

Lauren Burke, Childline Glasgow team manager, said: “At Childline, we know that coming out or speaking about sexuality and gender identity can be really challenging.

“Many children and young people who have spoken to our trained volunteer counsellors have described their time under lockdown as a period of reflection, a chance to think about important issues in their lives, both recent and historic.

“Some children with sexuality and gender concerns revealed that lockdown had been particularly hard for them, as they’d been cut off from their usual support networks. Whereas others told Childline that lockdown had given them the confidence and freedom to come out to their friends and family.

“No matter what a young person’s experience is with coming out or speaking about their gender identity or sexuality, at Childline we believe every young person has a right to be listened to and speak about any worries or questions they may have without feeling judged.

“If a young person feels unable to speak to a trusted adult in their life then we would encourage them to speak to Childline.”

Greenpeace Edinburgh volunteers target Tesco

On Friday morning, 5 stencilled messages, revealing that ‘Tesco meat = deforestation’ appeared outside the supermarket’s branches in Broughton Road, Earl Grey Street, Fountainbridge, Great Junction Street and Duke Street as part of an escalating nationwide protest before the supermarket chain’s Annual General Meeting.  

Delegates arriving for Tesco’s Annual General Meeting were greeted by activists holding giant letters spelling out the words ‘FOREST CRIME’ 10 metres wide at Tesco’s Welwyn Garden City headquarters on Friday morning.   

Thousands of personal, passionate and urgent pleas from Tesco customers for the supermarket to end its part in deforestation of the Amazon rainforest and other areas of Brazil were handwritten on the 1.5 metre high letters.

Two activists also read messages through loud hailers outside the meeting. In total 10,000 messages – many threatening a boycott of the supermarket if action wasn’t taken – were received by Greenpeace and delivered to Tesco as part of the peaceful direct action. A further 250,000 people have signed a petition calling on Tesco to drop forest destroyers. 

Throughout May and June, Greenpeace volunteers also left stencilled messages outside more than 270 stores. More stores will be targeted with a series of peaceful direct actions over the coming months calling out Tesco’s role in deforestation and fires across Brazil to cut through the supermarket’s greenwash.  

Ellie said: ‘“When you buy a chicken from Tesco Duke Street in Leith, it won’t mention the forest crime that took place to produce it. Tesco’s chicken supplier is owned by a company notorious for destroying the Amazon rainforest.

“And Tesco’s chicken is reared on soya that’s driving deforestation and fires across Brazil.  

“Indigenous peoples are facing an assault on their rights as forests like the Amazon are being slashed and deliberately burned for industrial meat production. It’s killing wildlife, the risk of future pandemics is increasing and it’s playing havoc with the climate.  

“10,000 shoppers have sent personal pleas for Tesco to drop forest destroyers from its supply chain – many threatening a boycott if it doesn’t. Tesco can’t afford to ignore them and we won’t stop campaigning until Tesco stops greenwashing and takes action.” 

Despite Tesco claiming to have met its deforestation targets, its meat is not deforestation-free. It buys British chicken and pork from suppliers owned by notorious rainforest-destroyer, JBS. 

JBS recently admitted it would accept deforestation in its supply chain for another 14 years. And Tesco continues to sell more soya-fed, factory-farmed meat than any other UK supermarket.

It has already failed to keep its promise of zero-deforestation by 2020 and its plans to buy soya ‘only from deforestation-free areas’ by 2025 are meaningless given the complete collapse in 2019 of talks involving traders like Cargill to agree protection for whole areas from soya.  

Ellie continued: “Are we really willing to let Tesco get away with such blatant greenwash when doing a weekly shop? Join us to take part in the protest from home by calling Tesco’s head office to demand it stops greenwashing and drops forest destroyers from its supply chain.

Housing Secretary Shona Robison has welcomed new joint statements from landlords reaffirming their commitment to supporting tenants facing difficulties during the pandemic.

Signed by representative bodies for local authorities, housing associations and private landlords, the statements underline the sector’s commitment to only taking eviction action as a last resort.

The move follows this week’s announcement by Deputy First Minister John Swinney of a £10 million grant fund to support tenants struggling to pay their rent as a direct result of Coronavirus (COVID-19). The new fund takes the Scottish Government’s total support for tenants during the pandemic to almost £39 million.

Ms Robison said: “We have been clear from the outset that eviction action must be an absolute last resort, when all other avenues have been exhausted and a tenancy is no longer sustainable, so I welcome these joint statements from across the rental sector.

“The actions already taken by the Scottish Government, local authorities, housing associations and private landlords have been essential to avoiding evictions. Our new £10 million grant fund to support those who are struggling to pay their rent will shore up these efforts and extend more support to those facing crisis due to the pandemic. We will work towards making the grant fund available later in the year, and we will work with stakeholders over the coming weeks to develop the details.

“Paying rent is an important tenant responsibility, and tenants in financial hardship should engage directly with their landlord. When landlords are flexible with their tenants, signposting them to the range of financial support that is available and coming to agreements to prevent and manage rent arrears, this sustains tenancies and keeps people in their homes, benefitting everyone. These actions are crucial to move towards a sustainable and fair recovery from the impact of COVID-19.”

Cllr Kelly Parry, COSLA Community Wellbeing Spokesperson, said: “Local authorities have worked closely with tenants during the public health crisis, to support them to stay in their homes.

“This is something we were doing previously, but became even more important as our homes became even more important to us over the months of the pandemic. I am glad to see the sector restate their commitment to support tenants, and would encourage any tenant facing financial challenges to work closely with their landlord and seek advice and guidance early.”

Sally Thomas, Scottish Federation of Housing Associations Chief Executive, said: “Housing associations and co-operatives have always worked hard to help tenants who are struggling to pay their rent through tenancy sustainment services.

“This includes support to access benefits, budgeting advice, hardship funds and employability services – and this work has increased during the pandemic. They arrange manageable payment plans for tenants in rent arrears and will never evict someone who has agreed to, and is meeting, the conditions. Every effort is made to keep people in their homes.

“Any tenant who is struggling financially should contact their housing association or co-operative for support and help in paying rent.”

John Blackwood, Scottish Association of Landlords Chief Executive, said: “The overwhelming majority of tenants and landlords are working together to sustain tenancies during the pandemic.

“We welcome the Scottish Government emphasising that tenants have a responsibility to pay their rent, and encourage landlords to work with their tenants and always treat eviction action as a last resort. Our members have been working closely with tenants to reduce rents and write off arrears wherever possible.

“We strongly welcome the £10 million grant fund the Scottish Government has announced to help ensure tenants do not build up debt through rent arrears that they would struggle to repay. It is important landlords remain sensitive and constructive when working with their tenants, and that tenants struggling due to the pandemic speak to their landlord as early as possible.”

The shared statement on private landlords and letting agents working together with tenants to avoid evictions reads:

In responding to the effects of the coronavirus pandemic, there are many examples of private landlords and letting agents who have gone further than ever before to engage with tenants as more people find themselves in difficulty for the first time because of Covid.

As the country comes out of lockdown it is our shared commitment to make sure that tenants in hardship because of Covid continue to get support to pay their rent and living expenses and we will continue to work together collectively to ensure this is done.

The Scottish Government will continue to explore all options for policy and financial support to enable tenants to work with their landlords and letting agents; to be aware of their rights and responsibilities and support them to address financial hardship due to Covid-19.

Alongside existing support of extended notice periods, Discretionary Housing Payments and the Tenant Hardship Loan Fund this will include a new £10m Grant Fund package to support tenants in crisis who are struggling to pay their rent because of financial difficulty caused by the pandemic and help landlords to support them.

Where a private tenant has suffered financial hardship because of the Coronavirus pandemic, eviction action should be an absolute last resort, when all other avenues have been exhausted and a tenancy is no longer sustainable.

We advise that private landlords and letting agents continue to work to the following principles – for the remainder of the pandemic and throughout recovery:

  • Intervene early to keep people in their homes and give them the support they need to stay there
  • Landlords and letting agents should work with tenants who are struggling and support them to make arrangements to pay rent through a plan that is manageable for them in the long term
  • All landlords and letting agents should be flexible with their tenants, signposting them to the range of financial support that is available to help prevent rent arrears as part of the pre-action protocols required prior to any eviction application to the Tribunal or Sheriff Court.
  • Landlords and letting agents should act compassionately and quickly to support people who are in financial hardship and wish to work with their landlord to reduce arrears.

Paying rent is an important tenant responsibility and, where a tenant is able to do so, they must continue to pay their rent.  To help do this, private landlords and letting agents from across the country have worked flexibly with their tenants to help them access the wide range of support on offer, and to sustain tenancies and prevent eviction action – as demonstrated in the annexed case studies.

Purpose of this statement

  1. To set out the current levels of support available for private rented tenants and to reaffirm the flexible and supportive approach private landlords and letting agents should and in many cases have been taking to help keep people safe in their homes and avoid eviction where tenants are struggling through no fault of their own to manage their rent payments
  2. To highlight real-life examples of private landlord practice since the start of the pandemic that has helped tenants in financial difficulty access support in order to sustain their tenancies.
  3. A complimentary statement has been developed with social housing landlords.

‘Hopeless’ Hancock resigns

Exchange of letters spells end of the road for hapless Health Secretary … for now at least

Hancock’s replacement is the Rt Hon Sajid Javid MP. The former Chancellor has been appointed as Secretary of State for Health and Social Care.

Health and Social Care Secretary Sajid Javid said: “I’m incredibly honoured to take up the post of Health and Social Care Secretary, particularly during such an important moment in our recovery from COVID-19. This position comes with a huge responsibility and I will do everything I can to deliver for the people of this great country.

“Thanks to the fantastic efforts of our NHS and social care staff who work tirelessly every day, and our phenomenal vaccination programme, we have made enormous progress in the battle against this dreadful disease. I want our country to get out of this pandemic and that will be my most immediate priority.”
