TUC: Is it too hot to work?

The TUC has urged employers to make sure their staff are protected from the sun and heat after the UK Health Security Agency (UKHSA) issued a heat-health alert yesterday.

A Level 2 heat-health alert has been issued for the South West, East Midlands, West Midlands, North West and Yorkshire and the Humber regions.

And a Level 3 alert has also been issued for the East of England, South East and London regions.

Both alert levels are in place until 9am on Friday (15 July), with warm weather forecast across the country throughout the course of next week.

Climate change means that the UK will be subject to more frequent and intense heat waves – putting workers at greater risk.

Health warning

Working in hot weather can lead to dehydration, muscle cramps, rashes, fainting, and – in the most extreme cases – loss of consciousness. Outdoor workers are three times more likely to develop skin cancer.

The TUC says employers can help their workers by:

  • Sun protection: Prolonged sun exposure is dangerous for outdoor workers, so employers should provide sunscreen.
  • Allowing flexible working: Giving staff the chance to come in earlier or stay later will let them avoid the stifling and unpleasant conditions of the rush hour commute. Bosses should also consider enabling staff to work from home while it is hot.
  • Keeping workplace buildings cool: Workplaces can be kept cooler and more bearable by taking simple steps such as opening windows, using fans, moving staff away from windows or sources of heat.
  • Climate-proofing workplaces: Preparing our buildings for increasingly hot weather, by installing ventilation, air-cooling and energy efficiency measures.
  • Temporarily relaxing their workplace dress codes: Encouraging staff to work in more casual clothing than normal – leaving the jackets and ties at home – will help them keep cool. 
  • Keeping staff comfortable: Allowing staff to take frequent breaks and providing a supply of cold drinks will all help keep workers cool.
  • Talking and listening to staff and their union: Staff will have their own ideas about how best to cope with the excessive heat.
  • Sensible hours and shaded areas for outdoor workers: Outside tasks should be scheduled for early morning and late afternoon, not between 11am-3pm when UV radiation levels and temperatures are highest. Bosses should provide canopies/shades where possible.

The law

There’s no law on maximum working temperatures. However, during working hours the temperature in all indoor workplaces must be ‘reasonable’.

Employers have a duty to keep the temperature at a comfortable level and provide clean and fresh air.

The TUC would like to see a change in the law so that employers must attempt to reduce temperatures if they get above 24 degrees C and workers feel uncomfortable. And employers should be obliged to provide sun protection and water.

The TUC would also like ministers to introduce a new absolute maximum indoor temperature, set at 30 degrees C (or 27 degrees C for those doing strenuous jobs), to indicate when work should stop.

With climate change bringing higher temperatures to the UK, the government needs a plan on how to adapt and keep workers safe.

TUC General Secretary Frances O’Grady said: “We all love it when the sun comes out. But working in sweltering conditions in a baking shop or stifling office can be unbearable and dangerous.

“Indoor workplaces should be kept cool, with relaxed dress codes and flexible working to make use of the coolest hours of the day.

“And bosses must make sure outdoor workers are protected with regular breaks, lots of fluids, plenty of sunscreen and the right protective clothing.”

The TUC has urged employers to make sure their staff are protected from the sun and heat, as the Met Office issues one of its new-style extreme amber heat weather warnings for the first time. 

The amber warning covers parts of Wales, all of south-west England and parts of southern and central England and will be in place until Thursday (22 July), when temperatures are expected to peak.

The TUC would like to see a change in the law so that employers must attempt to reduce temperatures if they get above 24degC and workers feel uncomfortable. And employers should also be obliged to provide sun protection and water for outdoor workers. 

The TUC would also like ministers to introduce a new maximum indoor temperature, set at 30degC – or 27degC for those doing strenuous jobs.

The TUC is also asking employers to consider additional needs that may arise in hot weather from coronavirus health and safety requirements. Frances O’Grady added: 

“It’s even more important to use PPE safely in this hot weather. Staff will need extra breaks to cool down if their equipment reduces ventilation. 

“And while many offices have air conditioning, few people have it in their homes. Lots of staff are still working from home, so they may struggle to work during the hottest parts of the day. Employers should allow flexible hours so people can work when it’s cooler.” 

Coronavirus: More than 350 deaths and 31,000 infections linked to exposure at work, new HSE figures reveal

Health and social care workers made up 70% of reported occupational deaths, GMB Freedom of Information request reveals 

More than 350 deaths and 31,000 infections have been linked to Covid-19 exposure at work, new Health and Safety Executive (HSE) figures reveal. 

The data, released in response to a GMB Freedom of Information request, shows that 31,000 the suspected cases of occupational exposure to coronavirus were reported to the Health and Safety Executive between 10 April 2020 and 13 March 2021.

367 workers’ deaths were suspected to be linked to workplace exposure to the coronavirus during the same period.

It’s likely the figures significantly underestimate the true extent of exposure and deaths among workers, warned the GMB Union.

GMB calls for urgent investment to make workplaces safe and full sick pay cover so that workers can afford to self-isolate.

Health and social care workers accounted for the overwhelming majority of infections and deaths notified under the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations (RIDDOR).  70 per cent of occupational deaths, or 257 fatalities, were recorded for workers in this group.  

In total, 2,134 staff infections and seven deaths that were linked to workplace exposure were also recorded in educational settings since the start of September, despite Ministers’ repeated assurances that schools and other educational establishments were safe. 

Occupational infections peaked in January at 5,710 and the highest monthly count of worker deaths (60) was recorded in February, according to the figures.    

26,705 infections were reported in England since 10 April 2020, while 2,228 infections were reported in Wales and 2,447 were reported in Scotland. Northern Ireland is not covered by the figures.  

Reports of infections and deaths should be filed ‘where there is reasonable evidence that the worker was exposed because of their work,’ according to the HSE, which means that many infections that cannot be directly attributed to a person’s work will not be recorded. The HSE acknowledges that ‘RIDDOR suffers from under-reporting’ and that ‘it is likely that [COVID-19] disease reporting is lower’ than the true rate. 

The new figures, which had not previously been published, were uploaded to the HSE’s website following a GMB Freedom of Information Act request. The Information Commissioner’s Office issued a Decision Notice last week which required the HSE to reply to the request after it initially failed to respond. 

Rehana Azam, GMB National Secretary, said: “No one should go to work in fear of their life. Each worker’s death was preventable and the damning reality is that too many workplaces are still not safe. 

“The fact that 70% of reported workers’ deaths are in the health and care sector should be a wake-up call, and sadly these figures are likely the tip of the iceberg.  

“Two thousand infections and seven deaths in educational workplaces since September is the final proof that Ministers reopened schools before they were safe. 
 
“Across the country too many people still face insecure workplaces and inadequate PPE. 

“These figures shine a new light on the abject failure of too many to keep workplaces safe. Seven out of ten reported infections were since the start of the second wave, when the steps required to limit the spread of the virus were well understood. 

“GMB calls on Ministers to urgently meet with unions, and for full sick pay cover to be provided to end the financial pressure that is leading to presenteeism and a greater spread of this terrible disease.’ 

‘Crucial moment’ for global workers’ rights as Amazon unionisation vote closes

The eyes of the trade union world are focused on Alabama as an Amazon workers’ campaign to unionise reaches a ‘crucial moment’, with the close of their recognition ballot later today (Monday 29 March).

In what’s been marked as a turning point for labour relations in the United States, workers are organising under the banner of the Retail, Wholesale and Department Store Union (RWDSU) to demand better working conditions and an end to worker surveillance at the Amazon Fulfilment Centre in Bessemer, a south western suburb of the city of Birmingham.

RWDSU representatives will join GMB Scotland union organisers on Wednesday evening at for a special online event, ‘Demands for a Post-COVID World of Work’, to inform and discuss the Bessemer unionisation campaign and its impact on the fight for recognition in Amazon across the world.

GMB Scotland Secretary Gary Smith said: “This is a crucial moment for workers’ rights but whatever the outcome in Bessemer this unionisation drive is a point of no return for Amazon, not just in the United States but across the world and including Scotland.

“It is a basic human need to want proper value for our work and for that work to be underpinned by basic rights and protections, and it’s why there is a reawakening of the need for unionisation to achieve it.

“The clock is ticking on the unfettered greed of billionaire disrupters and practitioners of precarious work because the COVID-19 pandemic has surfaced all the underlying exploitations that have been left unchallenged over the last decade.

“We are delighted that representatives from Alabama will be joining on us on Wednesday because the challenges facing Amazon workers in Bessemer are the same as those in Bathgate, and we need to learn from each other to make work better post-COVID.”
