England cracks down on ‘anti-driver’ road schemes to put local consent first

Plan for Drivers will ‘improve drivers’ lives, shorten journey times, and ensure traffic measures have buy-in from the people they impact

Motorists in England are set to benefit from smoother journeys and reduced congestion, with local people getting a stronger voice on road schemes that affect them, thanks to a crackdown on anti-driver road schemes, over-zealous traffic enforcement, and strengthened guidance for councils on 20mph limits.

These are among the latest raft of measures to be announced from the Westminster government’s Plan for Drivers.

The Department for Transport has today (17 March 2024) published draft statutory guidance for councils on low traffic neighbourhoods (LTNs), setting out that they must gain buy-in from local residents, businesses and emergency services when considering implementing new LTN schemes.

This could involve in-person events, online engagement, and leaflet drops to involve the whole community in the process and will mean that authorities must consider whether an LTN has local support before it is implemented.

The new guidance raises expected standards for LTNs and will come into force this summer when local authorities will be obliged to consider it when shaping new and existing schemes.

Local authorities are expected to follow the guidance and ensure local people support their plans. Recent examples where councils have implemented these schemes without public support have been shown to cause disruption and have unintended negative consequences.

If local authorities fail to deliver sensible road schemes that work for local people they could see future funding withdrawn, and under powers from the Traffic Management Act, the government could ultimately take control of an authority’s roads where they are deemed to be widely mismanaged.

A consultation will also be launched this summer on measures including the removal of local authorities’ access to Driver and Vehicle Licensing Agency (DVLA) data to enforce such schemes by camera.

Separately, councils have received strengthened guidance on setting 20mph speed limits, reminding them to reserve them for sensible and appropriate areas only – such as outside schools – and with safety and local support at the heart of the decision. Local authorities are expected to consider this guidance, and as with the LTN guidance, this could have implications for the awarding of funding in the future.

The action taken today on LTNs is supported by a wide-ranging review that highlights only 13% of residents have responded to councils’ planning consultations on LTNs, and just 18% feel that their views have influenced council decisions.

The report also found that local authorities operating LTNs issue an average of 36,459 penalty charge notices per scheme, with the highest number of penalty charge notices issued for a single LTN scheme exceeding 170,000. That’s why the guidance embeds the need for local support and will ultimately save motorists money.

While the review showed only a quarter of people understood the benefits of LTNs, it also flagged concerns over the impact on disabled residents, high numbers of penalty charge notices, the cost of LTN schemes and even concerns from emergency services that delays to crews caught up in LTNs could “potentially risk lives”.

The new guidance aims to prevent councils having to reverse poorly-implemented or locally unpopular schemes – as with recently removed LTNs at Jesmond, Newcastle and Streatham Wells, London.

These measures from our 30-point Plan for Drivers will improve the lives of drivers, shortening journey times and ensuring traffic measures have buy-in from the people they are impacting. 

Transport Secretary Mark Harper said: “We want local people to have their voices heard, and any traffic schemes to have the consent of those they impact.

“Well thought out schemes, like 20mph limits outside schools, can make our roads safer, but we are raising the bar to help ensure all traffic schemes work for everyone in the community.

“We’re on the side of drivers, and these latest measures show we’re getting on with delivering what we promised in our Plan for Drivers – making their lives better, fairer and cheaper, and helping people travel in the way that works best for them.”

Today’s announcement also sees a comprehensive package of other measures designed to put people back in the driving seat.

Traffic lights will be upgraded across the country thanks to £50 million – £30 million to replace outdated equipment, and £20 million to reduce poor traffic light performance through innovative technology that responds to live traffic conditions. From Devon to Durham, 80 highway authorities across England will benefit from funding, to improve journey times and reduce congestion caused by red lights.

Consultations are also launching focusing on preventing local councils from turning drivers into ‘cash cows’ by profiting from enforcing traffic restrictions. This includes fines for drivers going into yellow box junctions or parking restrictions. The 8-week call for evidence will seek views from residents and will also quiz local authorities on how money from fines is reinvested.

Local people will have their say on whether they think enforcement is currently fair or believe authorities should be restricted in their traffic enforcement powers, and the findings will inform future government decisions on restricting authorities. As with LTNs, the government will also look at restricting local authorities access to third-party data, such as the DVLA database, for enforcement purposes.

At the moment, restrictions on bus lane use are too rigid, creating delays and causing regular fines for drivers. New guidance on bus lanes has also been issued today, to make sure they only operate when it makes sense, like when traffic is heavy enough to delay buses. This will prevent drivers being hit with unfair fines.

A consultation will also be launched to look into whether motorcycle access to bus lanes should be standard, a further initiative to reduce congestion and speed up journey times.

Further measures announced today include publication of new guidance making it simpler and easier for councils to charge utility companies who slow down drivers with street works and a consultation aiming to shake up motor insurance will also be launched to prevent those caught without it from claiming property damage from the Motor Insurers’ Bureau. 

Nuisance boy-racers who illegally modify their exhausts and disturb our streets are also being targeted. New research reveals the success of noise cameras in cracking down on illegally modified exhausts and anti-social drivers. The research will be used to encourage local authorities to install noise cameras after successful trials in Bradford, Birmingham, Bristol and Great Yarmouth.

The UK Government’s Plan for Drivers has already delivered measures to crackdown on disruptive streetworks, cutting traffic and anticipated to generate up to £100 million over the next 10 years.

It has also launched grants for schools to accelerate the rollout of electric vehicles chargepoints, making it easier for drivers to make the switch.

A record £8.3 billion has also been pledged over the next 10 years for road resurfacing, made possible by reallocated HS2 funding, to improve the condition of British roads and speed up journey times.

RAC head of policy Simon Williams said: “We’re very pleased to see the government responding to our calls for clearer guidance on yellow box junctions with their consultation on the misuse of these measures.

“It’s also extremely positive to see progress made on the installation of noise cameras, after 6-in-10 drivers (58%) told us they would be in favour of these measures last year. Excessive noise pollution is not only extremely frustrating, it could also have a really serious impact on residents’ health and lives, and until this point there’s been very little anyone can do about it.

“We’re keen to see if this new technology goes some way towards resolving the issue and hope it can be rolled out quickly and efficiently.”

UK Government announces new long-term plan to back motorists

Plan for drivers ‘will sit alongside continued investment in public transport and active travel’

Transport Secretary Mark Harper has set out plans to protect drivers from over-zealous traffic enforcement, as part of a long-term government plan to back drivers.  

With 50 million people holding a driving licence in Great Britain and more than 40 million licensed vehicles in the UK, the government’s new plan will support the majority who drive, by keeping motoring costs under control and ensure people have the freedom to drive as they need to in their daily lives.

The measures include reviewing guidance on 20mph speed limits in England to prevent their blanket use in areas where it’s not appropriate and amending guidance on low traffic neighbourhoods to focus on local consent.

As part of the ongoing review into low traffic neighbourhoods, the government will also consider measures for existing anti-driver policies that did not secure local consent. The plans also aim to stop councils implementing so called ‘15-minute cities’, by consulting on ways to prevent schemes which aggressively restrict where people can drive.

Drivers across the country will also soon be able to benefit from new technology to simplify parking payments. The national parking platform pilot will be rolled out nationwide so that drivers can use an app of their choice to pay instead of downloading multiple apps.

In the continued drive to tackle potholes, the government will support councils to introduce more lane rental schemes, where utility companies are required to pay to dig up the busiest roads at peak times. Under the proposals, at least half of the extra money raised from these fees will go directly towards repairing road surfaces.

To further clamp down on overrunning street works, the government will consult on extending fines for repairs which run into weekends and increasing current levels of fixed penalty notices.

Prime Minister Rishi Sunak said: “For too long politicians have focused on the short-term decisions with little regard for the long term impact on hardworking families.

“We’ve seen this consistently with people’s freedoms on transport. The clamp down on drivers is an attack on the day to day lives of most people across the UK who rely on cars to get to work or see their families.

“This week the UK government will set out a long-term plan to back drivers, slamming the brakes on anti-car measures across England. We are taking the necessary decision to back the motorists who keep our country moving.”

Transport Secretary Mark Harper said:  “Too often the private car is vilified when it has been one of the most powerful forces for personal freedom and economic growth. That’s why the government is taking the long-term, necessary decision to back the motorists who keep our country moving. 

“We’re introducing a plan to ensure drivers can enjoy smoother journeys, park more easily and no longer face unfair and oppressive traffic enforcement measures.

“Our plan will sit alongside our continued investment in public transport and active travel as part of a package of measures designed to help people travel in the best way that works for them.”

A call for evidence will be launched on options to restrict the ability of local authorities to generate revenue surpluses from traffic offences and over-zealous traffic enforcement, such as yellow-box junctions.

To make life easier for drivers and help traffic flow better, the Department for Transport will strengthen guidance to make sure bus lanes only operate when necessary and a consultation will be launched on motorcycles using bus lanes. Further measures and the full plan will be published in the coming days.

The measures follow the Prime Minister’s new approach to net zero announced last week, which committed to ending the sale of new petrol and diesel vehicles by 2035, while supporting people who rely on their cars in their daily lives. The long-term plan to back drivers will protect people who rely on their cars from anti-driver policies.  

The plans also follow the government’s support for drivers by cutting the fuel duty rate by 5p per litre since March 2022, saving the average driver around £100 a year. This is in addition to £5 billion government investment since 2020 to resurface local roads, and new rules to clamp down on utility companies leaving potholes behind after street works.

Corstorphine Connections: pupils reimagine their school streets

Children in Corstorphine have become urban designers to help create safer, more welcoming streets in their local neighbourhood.

As COP26 takes hold of Scotland, pupils from Carrick Knowe and Corstorphine Primary Schools have been sharing ideas to help people make healthy, low carbon journeys by walking, wheeling or cycling, as well as improving the environment, in their own corner of the country.

The city council is engaging with the community as part of Corstorphine Connections, a project to introduce a Low Traffic Neighbourhood (LTN), and are asking residents to share their views on proposals to improve the look and feel of the area.

The design proposals have been developed after receiving initial feedback from residents, including these designs for school streets by local children. Amongst their ideas are more trees, grass and flowers, spotty patterned roads and paw prints along the street to signpost safe routes.

Councillor Lesley Macinnes, Transport and Environment Convener, said: “We owe it to future generations to create a city that is healthy, sustainable and safe to move around by foot, wheel or bike. So it’s fantastic that we’ve been able to involve our youngest citizens in the development of Edinburgh’s first LTN – they’ve got some great ideas.

“We’ve seen from neighbourhoods around the world how LTNs can have a really positive impact on travel habits and quieter, more pleasant streets for residents and businesses, so I really look forward to delivering these benefits in Edinburgh.”

Councillor Karen Doran, Transport and Environment Vice Convener, added: “We really want to bring the Corstorphine community with us as we develop this LTN, and we’ve already been listening to ideas and concerns as we move through the process.

“These designs demonstrate the impact the layout of our streets can have an all members of society, young and old, so it’s been really helpful to hear what local school pupils think.”

Dan Jeffs, Senior Urban Designer at Sustrans Scotland, said: “Sustrans has been working closely with Corstorphine Primary School and Carrick Knowe Primary School to identify placemaking measures for spaces immediately outside their schools and within the wider area.

“These measures will help create safer, more enjoyable and attractive streets and spaces for children and local residents, as well as encourage and promote walking, wheeling and cycling in the area.

“People are being invited to have their say on placemaking ideas for Corstorphine, such as hanging baskets and ‘pencil bollards’ to protect children outside the school on Corstorphine High Street and new seating and colourful road surfaces to prioritise pedestrians on Saughton Road North.

“Two options for a ‘pocket park’ on Featherhall Avenue have also been put forward for feedback.”

Plans to start the Experimental Traffic Regulation Order (ETRO) process to introduce an LTN on a trial basis in Corstorphine were approved by Transport and Environment Committee in August, following engagement with the community on key issues and, subsequently, concept designs.

The LTN aims to create a safer environment, providing more opportunities for residents to walk, wheel, cycle and spend time in by reducing vehicle volume and speed.

In Corstorphine, residents have previously told the council about concerns around the level and speed of traffic there, which is backed up by CEC’s own monitoring.

By implementing an LTN the council hopes to create a calmer, more relaxed environment for travel by foot, wheel or bike. It is planning to introduce the LTN on a trial basis, using an ETRO, in early spring 2022.

LTNs form part of the City Mobility Plan, Edinburgh’s ten-year transport strategy envisioning a better-connected, safer and more inclusive net zero carbon transport system. The council is also working towards the introduction of an LTN in Leith next summer.

Low Traffic Neighbourhoods: have your say!

Community engagement to help develop proposals for Low Traffic Neighbourhoods (LTNs) in three parts of the city has begun. The city council is proposing measures to make it safer and more comfortable to walk, cycle, wheel and spend time in Leith, Corstorphine and East Craigs.

Following public engagement and subject to committee approval the schemes would be introduced under an Experimental Traffic Regulation Order. The council says this provides further opportunities for public involvement in refining measures, even once they’re in place:

‘We’re now seeking residents’ views on travel choices and spaces for movement and relaxation in the relevant areas. Feedback will be used to inform design proposals for each of the schemes, which are the first in a potential programme of low traffic neighbourhoods being considered across the city.

‘In Leith, we’re also developing a protected cycle lane between the Foot of the Walk and Ocean Terminal, which will complement the adjacent Trams to Newhaven project, as well as pedestrianizing Sandport Place Bridge and creating a bus-only section at the Shore. We’re seeking people’s views on concept designs as part of the engagement.’

Transport and Environment Convener Councillor Lesley Macinnes said: “As we look to make a green recovery from the pandemic, it’s important that we get back to work on our long-term plans to support sustainable, active travel and healthy communities, where children can play safely and air pollution is reduced.

“There’s a range of research to show the positive impact LTNs can have on reducing ‘through’ traffic and encouraging people to walk, cycle, wheel and spend time in local areas. We want to bring these benefits to neighbourhoods across Edinburgh and to make sure the changes work for everyone, which is why we want to hear from as many people as possible.”

Transport and Environment Vice Convener Councillor Karen Doran said: “We envision a much safer, more relaxing and ‘people-friendly’ Capital, which is why we’re developing LTNs for different communities.

“By introducing them on an experimental basis we want to involve the people that live here in their evolution, and their participation begins now, as we start to develop designs.”

LTNs are initiatives where motor vehicle traffic is significantly reduced in residential streets, limiting the volume of ‘through traffic’ while maintaining vehicle access for people who live there. This creates a safer, more pleasant and inclusive environment for walking, cycling, wheeling and playing, reducing air pollution, encouraging healthy, active travel and opening up space for improvements like pocket parks, seating areas and planting.

Various studies have demonstrated the positive impacts similar schemes introduced elsewhere in the UK have had on communities. In London, research has shown the ‘mini-Holland programme’, introduced in boroughs across the city, saw a trend toward reduced car use and an increase in active travel. 

Data collected on the Walthamstow Village LTN found a drop of approximately 50% in traffic while a scheme in Dulwich Village reported a 96% increase in cycling, including a rise in the number of children on bikes.

Each of the schemes being put forward for Edinburgh responds to needs and issues specific to the neighbourhoods, including –

Corstorphine: Creating safer routes to school, addressing issues with speed and volume of traffic in residential streets, creating new public spaces and improving cycle routes, including links to the future West Edinburgh Link

East Craigs: Protecting streets from the impact of new developments in the west of Edinburgh, creating safer routes to school, addressing issues with speed and volume of traffic in residential streets and improving cycle routes, including links to the future West Edinburgh Link

Leith: Enhancing and promoting access to public transport, improving cycling provision in the area, addressing issues with traffic volume and speed in residential streets.

The city council says proposals being developed are ‘entirely separate and distinct from any temporary measures being implemented as part of the Spaces for People programme‘.

As part of the engagement process ‘community reference groups’ are being formed of representatives from community and interest groups in each of the areas, offering additional opportunities for residents to feed back. However, this will not supersede the responses gathered as part of the consultation process.

Following community engagement, design proposals will be developed for the three LTNs, which will then be shared for further public engagement.

Designs will then be refined and brought to Transport and Environment Committee in June for approval and permission to start the Experimental Traffic Regulation Order (ETRO).

Subject to committee approval, following ETRO consultation, changes would be implemented on a trial basis in October.

For the Foot of the Walk to Ocean Terminal active travel improvements, further development of existing designs will follow feedback, with the aim of publishing Traffic Regulation Orders later this year and beginning construction in 2022.

Committee to discuss controversial Low Traffic Neighbourhoods

Proposals for a Low Traffic Neighbourhood in East Craigs will be considered by Transport and Environment Committee this morning (Thursday 1 October).

The temporary measures are being proposed as part of our Spaces for People programme and, following concerns raised by the local community, will be brought to committee for a final decision by councillors.

In response to feedback from residents, the design of the scheme has been amended to ensure that every area in the Low Traffic Neighbourhood can access (entry and/or exit) two of the major distributor roads, Drum Brae, Glasgow Road or Maybury Road.

The council says that by making these amendments, it will alleviate the requirement for right turns across Drum Brae South and Glasgow Road, which have been key concerns of residents. However, it will also ensure that routes used by vehicles to avoid the A8 corridor are closed, particularly during Craigmount High School’s opening and closing times. In addition, it will take traffic away from the West Edinburgh Link north-south cycle route.

Councillor Lesley Macinnes, Transport and Environment Convenor, said: Low Traffic Neighbourhoods allow residents to move around their own areas safely and with more space. They encourage physical activity and reduce through traffic.

“We know through feedback we have received that local people want to see measures improved for walking, wheeling and cycling and this is an opportunity to make this a reality on a temporary basis.

“However, we recognise that a number of people have been opposed to the measures we are looking to implement, so we felt it was right to refer this matter to the Transport and Environment Committee for proper scrutiny by elected members.

“We have listened carefully to local concerns and are proposing a number of changes to address the issues raised by the community. This will make vehicle access easier for local residents while moving ahead with some elements that will bring positive changes for residents. There is also a clear commitment to continue monitoring its effect and to modify it where necessary.

Councillor Karen Doran, Transport and Environment Vice Convenor, said: “We know that Low Traffic Neighbourhoods reduce emissions and calm traffic due to the number of successful schemes that have already been implemented across the UK.

“Nevertheless, there is local opposition to this scheme and it should be discussed and agreed by the Transport and Environment Committee before we take steps to implement. We will continue to engage with residents and stakeholders regarding this matter and ensure that their voices are heard as we move forward.”

The report will also consider other potential Low Traffic Neighbourhoods across the city, including the Meadows, Leith and the South Corstorphine area.

The East Craigs Low Traffic Neighbourhood involves temporary measures and is not a permanent scheme. Once implemented we will continue to monitor its success and engage with local residents. If a view is taken to make the scheme permanent full consultation with residents would take place.

Low Traffic Neighbourhoods are used in a number of cities to reduce the impact of through motor traffic. They create people-friendly spaces which encourage physical activity and active travel choices while maintaining local access. Our consultation on the West Edinburgh Link (WEL) project showed support for proposals to improve conditions for active travel. We also received a number of suggestions via our Commonplace online tool on how the area could be made safer for residents.

The amended measures for the East Craigs scheme include – 

  • Removing the Craigmount Avenue and Craigs Loan modal filters
  • Changing the position of the Craigs Gardens modal filter
  • Changing the North Gyle Terrace filter to No Entry east bound (from Maybury Road)
  • Altering the Craigs Road bus gate so that it always permits one-way westbound traffic and restricts eastbound traffic at peak times (07:30 – 09:30 and 16:00-18:30)
