Holyrood Committee welcome commitment to increased culture funding but call for more clarity and greater certainty

A year on from the Scottish Government commitment to increase investment in culture by £100 million annually by 2028-29, stakeholders have indicated confidence in the culture sector remains low due to the lack of clarity from the Government regarding how the additional investment will be rolled out, say the Constitution, Europe, External Affairs and Culture Committee.

The Committee say the Scottish Government should provide this greater clarity and certainty to the sector following the UK Spending Review, when it has more clarity on its longer-term budgetary outlook. The findings are part of the Committee’s pre-budget scrutiny of the culture portfolio ahead of the Scottish Government Budget 2025-26.

The Committee says it recognises the challenging environment facing public finances currently and welcome the Scottish Government’s commitment to increase investment in culture by £100 million annually by 2028-29. It also welcomes the intended minimum £25 million increase in culture funding for 2025-26.

The Committee say the recent temporary closure of the Open Fund for Individuals was unhelpful given the urgent need to restore confidence in the culture sector.

It says it’s unclear why Creative Scotland and the Scottish Government were unable to resolve any issues before the fund closure was announced and is seeking reassurances from both that lessons have been learned from the significant uncertainty this caused to the sector.

The Committee add that the recent postponement of announcing the Multi-Year Funding Programme outcomes until January 2025, a matter of weeks before those decisions were scheduled to be announced, has led to yet more uncertainty for the sector.

The Committee say there is a need for a substantially improved relationship between Creative Scotland and the Scottish Government and therefore welcome the proposed review of Creative Scotland.

As part of this review the Committee say it should review the legislation which sets out Creative Scotland’s statutory roles and responsibilities, consider where it sits within the wider culture sector, and the level of resourcing it requires to fulfil its functions.

Following the significant concerns highlighted by the Committee regarding Creative Scotland’s handling of the funding for Rein, the Committee say the review must also consider effective governance and transparency. 

The Committee also welcome that this will form part of a wider review of the way the culture sector is supported, which it says will be valuable in supporting the effective distribution and investment of additional funding for the sector. However, the Committee say it is key this review does not delay the delivery of additional investment, including the planned minimum £25 million additional funding for 2025-26.

The Convener of the Constitution, Europe, External Affairs and Culture Committee, Clare Adamson MSP, said: “We recognise the funding challenges facing the Scottish Government and we welcome their commitment to increase investment in culture by £100 million annually by 2028-29 and the intended £25 million at least increase for culture in 2025-26.

“We think the Scottish Government should provide greater clarity and certainty to the culture sector on planned funding increases following the UK Spending Review, when it has greater clarity on its own budgetary outlook as this can increase confidence in the sector.

“There must also be a strategic approach taken for any increased funding to ensure the Scottish Government maximises the impact of the increased investment in culture that it has committed to deliver. That’s why we welcome the review of the way the culture sector is supported.”

The Deputy Convener, Alexander Stewart MSP added: “The temporary closure of Creative Scotland’s Open Fund for Individuals and the postponement of announcing the outcomes of their Multi-Year Funding Programme only add to the feeling of uncertainty and precariousness across the culture sector.

“We believe the relationship between Creative Scotland and the Scottish Government must substantially improve and while we welcome the proposed review of Creative Scotland, we recommend it should be independent and look at effective governance and transparency.

“We support this forming part of a wider review of the whole culture sector, how it is supported and funded, in order to foster a sustainable and thriving sector for all.”

Boundaries Scotland are reviewing Scottish Parliament boundaries to make them more fair.

The Second Review of Scottish Parliament Boundaries started in September 2022. In early 2023 and again in April/May 2024 we consulted on proposals for constituency boundaries and names.

We are now consulting on Provisional Proposals for region boundaries and names.

The rules that govern Scottish Parliament region design are

  • a constituency must fall wholly within a region.
  • the electorate of a region must be as near the regional electorate of each of the other regions as is practicable, having regard (where appropriate) to special geographical considerations.

Why is this happening?

Boundaries Scotland undertakes reviews of Scottish Parliament boundaries every 8 -12 years to ensure each region or constituency has an equal number of electors.

Turmoil at Edinburgh Rape Crisis Centre following critical report

ERCC Chief Executive resigns

Rape survivors are no longer being referred to an Edinburgh support service after a review found Edinburgh Rape Crisis Centre failed to protect women-only spaces.

The report, which was commissioned by parent body Rape Crisis Scotland, says ERCC’s chief executive officer – a trans woman – failed to behave professionally and did not understand the limits of her authority.

The report also found that Edinburgh Rape Crisis Centre had not put survivors first or adhered to national service standards.

Rape Crisis Scotland, Edinburgh Rape Crisis Centre’s parent body, issued the following statement in response to the independent review:

The independent review of Edinburgh Rape Crisis Centre (ERCC) has presented challenging findings, and recommendations for improvements to the organisation, its operations, and how it provides services. It also makes important recommendations for Rape Crisis Scotland (RCS), which we accept and will act on.

‘We are extremely concerned that for around 16 months ERCC did not provide dedicated women only spaces, as required by the National Service Standards, while declaring to RCS that they were adhering to the standards. This is a significant breach.

‘We have asked ERCC to produce an action plan, with clear timescales, to implement the review’s recommendations. We have also requested that ERCC conducts an urgent review of its data protection and safeguarding policies and procedures, and they have confirmed that this work is underway.

In the meantime, we have paused referrals to ERCC. Our helpline workers can discuss alternative support arrangements with survivors in Edinburgh at this time.

‘The needs of survivors should be listened to and respected when they come to any Rape Crisis Centre. It is important that survivors can make informed choices about the services they access at Rape Crisis Centres, and we recognise that for some survivors this includes the choice of a single sex service.

‘We are working with our member Rape Crisis Centres across Scotland to consider what more we need to do to ensure survivors can make informed choices about the support they receive from Rape Crisis Centres, to ensure they are able to access the services they need.

‘All member Rape Crisis Centres are signed up to working within National Service Standards which operate across Scotland, and England and Wales. These standards detail the high quality of service every survivor should expect to receive from a Rape Crisis Centre. Membership of Rape Crisis Scotland is based upon a shared commitment to, and evidencing of, the Rape Crisis National Service Standards.

“Over the next year, we will go through a process of assessment with our member centres to support them to evidence that the National Service Standards are being met across Scotland.”

That response is simply not good enough for some organisations that work with women, however. Women’s rights group FOR WOMEN SCOTLAND issued the following statement:

We are saddened – if unsurprised – that Edinburgh Rape Crisis Centre has been found wanting in so many respects.

‘The Review Report lays bare the failings which have impacted the most vulnerable women. While Edinburgh RCC, undoubtedly, adopted a particularly extreme and egregious version of gender identity ideology and relentless pursued anyone who dared to question their policy of self ID, similar issues are apparent in other centres in Scotland and in Rape Crisis Scotland itself.

Sandy Brindley (Chief Executive of Rape Crisis Scotland – Ed.) has been repeatedly warned by women in the Rape Crisis Network, by survivors, and by women’s rights organisations that self-ID policies were reckless and cruel.

‘Nevertheless, she insisted – including to a group of survivors – that men were women if they claimed a female identity, she vigorously defended Mridul Wadhwa who conducted the heresy hunt in ERCC, and she presided over the introduction of policies which included trans-identified men in women only services.

In several Parliamentary appearances, she claimed that these policies did not create any problems in running rape crisis services. That has now been exposed for the lie it always was.

‘We believe that the problems are endemic and structural, and they cannot be resolved simply by rearranging the deckchairs at ERCC. As a matter of priority, Mridul Wadhwa must be removed from post, but those board members who presided over his tenure and defended him at Roz Adams’ tribunal must also go.

‘We also believe that Sandy Brindley’s position is also now untenable. Fortunately, women in the Lothians have an alternative women-only service and we believe that Rape Crisis Scotland should, as a matter of urgency, confirm that Beira’s Place will be able to take on referrals.

‘Beira’s Place should also be involved in restructuring both the local and national services. Only these measures will restore trust in this critical service.

Too many women were betrayed and harmed – this must never happen again.’

It has been announced this morning that ERCC Chief Executive Mridul Wadhwa has stepped down:

Mridul Wadhwa and the Board have decided that the time is right for a change of leadership in at Edinburgh Rape Crisis Centre (ERCC).  

Mridul has stood down from her role as CEO of ERCC. Recruitment of a new CEO will happen in due course.  

We are committed to delivering excellence while taking on board the recommendations from the independent review to ensure we place survivors voices at the heart of our strategy.  

We are in daily communication with Rape Crisis Scotland, have met their urgent demands, and are currently implementing the recommendations in the report.

“We will continue to work alongside RCS to ensure our services not only meet but exceed the National Service Standards.

ALBA MSP Ash Regan said: “The Minister for Equalities must now report to Parliament on what steps will be taken to ensure those at the government-funded Rape Crisis Scotland, who presided over the unlawful introduction of males within their single-sex service, are accountable for their part in this damaging dereliction of duty to service users.

“Thank goodness @jkrowling stepped up for Lothian women with the single-sex trauma service @beirasplace in 2022.”

Former Edinburgh MP Joanna Cherry KC said: “I’m glad to hear that Mridul Wadwa is no longer the CEO of Rape Crisis Edinburgh but the appalling culture over which this man who identifies as a woman presided goes much deeper.

“This should not be an end of the matter. Others need to consider their position”.

Review of powers of communities to acquire land or buildings

A review of Community Rights to Buy will begin this summer to look at how effective current powers are.

Community Right to Buy has now been in use for 20 years. During that time, there have been several additions and amendments to the original rights in the Land Reform (Scotland) Act 2003, and various reports and recommendations on how to improve and amend them further.

Speaking during a visit to the Heart of Newhaven, a community facility which was bought by the community in 2021 through the Asset Transfer process, Rural Affairs Secretary Mairi Gougeon said: “Ownership or control of land and buildings – both urban and rural – is a powerful tool for communities to drive change and achieve their goals. It can help to develop the local economy, provide activities and services, and boost community identity.

“We want to increase community ownership as an important way of delivering our vision for Scotland and our three central missions of equality, opportunity and community.

“This review will begin in Summer 2024, following introduction of the Land Reform Bill and report at the end of 2025 and will cover all the current rights to buy and will look at legislative and procedural aspects of the rights to see if new legislation is needed.”

Background

The Land Reform (Scotland) Act 2003 introduced the first two community rights to buy.  The Community Right to Buy (Part 2) gave rural communities the right to register an interest in assets.  Should the owner choose to sell, the community could then be granted the right to buy that asset without it being offered to anyone else.  The Crofting Community Right to Buy (Part 3) gave communities in crofting areas a right to compulsory purchase of assets, whether or not the owner wishes to sell.

The Community Empowerment (Scotland) Act 2015 then amended the Community Right to Buy to widen the rights to urban communities.  It also introduced the Community Right to Buy Abandoned, Neglected or Detrimental Land (Part 3A).  This is a compulsory purchase right for land that is abandoned, neglected or detrimental to the environmental wellbeing of communities.

The Land Reform (Scotland) Act 2018 introduced a further compulsory right, the Right to Buy Land to Further Sustainable Development (Part 5).  This compulsory right does not need land to be in a certain condition and allows communities to nominate a third party purchase on their behalf.

Have your say on constituency boundary changes

YESTERDAY the Boundary Commission for Scotland released its proposals to redraw the boundaries of Scottish Parliamentary constituencies (writes Edinburgh Western MSP Alex Cole-Hamilton).

As Scotland changes, this review is mandated of the commission, so that population growth in some areas and decline in others is reflected in how areas are represented in the Scottish Parliament.

The proposals for West Edinburgh redraw our constituency entirely, with the communities of Kirkliston, South Queensferry, Cramond, Cammo, Barnton, Davidson’s Mains and Muirhouse all removed from Edinburgh Western Constituency and combined with the towns of Linlithgow, Broxburn and Uphall to create the new constituency of Edinburgh Forth and Linlithgow.

Corstorphine, East Craigs, Craigmount and Drylaw and Blackhall will remain in Edinburgh Western and the seat will expand East to include Inverleith, Stockbridge, Murrayfield and Ravelston. Part of South Gyle will now move to Edinburgh Pentlands.

New review to boost employment prospects of autistic people

A new review designed to boost the employment prospects of autistic people hasUKtoday been launched by the UK Government

  • Sir Robert Buckland KC MP to lead new Autism Employment Review
  • Focus on supporting employers to recruit and retain autistic people and reap benefits of a neurodiverse workforce
  • Recommendations for change to be brought to Government later this year

A new review designed to boost the employment prospects of autistic people has been launched by the Government to spread opportunity, close the employment gap and grow the economy.

The Secretary of State for Work and Pensions, Mel Stride MP, has appointed Sir Robert Buckland KC MP to lead the review, which will consider how the Government can work with employers to help more autistic people realise their potential and get into work.

People with autism have particularly low employment rates – with fewer than three in 10 in work – but the Buckland Review of Autism Employment, supported by charity Autistica and the Department for Work and Pensions (DWP), is aiming to change that.

The Review will ask businesses, employment organisations, specialist support groups and autistic people to help identify the barriers to securing and retaining work and progressing with their careers.

The Minister for Disabled People, Health and Work, Tom Pursglove MP said: “We know autistic people can face barriers moving into employment and staying there. This is often down to the employers themselves not having the tools to support autistic people, or truly understanding the value of a neurodiverse workforce.

“This important review will provide us with vital information to remove these barriers and help more autistic people start, stay and succeed in work by ensuring more employers provide truly inclusive places to work. I look forward to seeing the recommendations from the review.”

Rt Hon Sir Robert Buckland KC MP said: “I am delighted to have been asked to lead this important Review. Our workplaces and businesses would benefit so much from the huge potential that autistic people represent.

“If we close the employment gap for autistic people, it will not just mean individual fulfilment but a significant boost to employment and productivity for our country.”

The Buckland Review of Autism Employment will consider issues including:

  • how employers identify and better support autistic staff already in their workforce;
  • what more could be done to prepare autistic people effectively for beginning or returning to a career;
  • and working practices or initiatives to reduce stigma and improve the productivity of autistic employees.

It will focus specifically on autistic people, and aim to develop solutions that:

  • will be acceptable to autistic people.
  • will be effective at improving autistic people’s outcomes.
  • will be feasible for employers or public services to deliver.

The Review will also look at employers who are benefitting from a neurodiverse workforce, like London manufacturer KwickScreen. The innovative company provides transparent screens to every UK hospital and played a pivotal role in the NHS’s response to the Covid pandemic.

On a recent visit to their Lewisham base, the Minister and Sir Robert discovered many of the breakthrough initiatives in the company came from the neurodiverse members of the team.

Dr James Cusack, Chief Executive of the UK autism research and campaigning charity, Autistica said: “The benefits for autistic people and society will be huge if we can give autistic people the opportunity to work and thrive in employment. That’s why as a charity we want to see a doubling of the employment rate for autistic people by 2030.

“We are delighted to support the government on this vital review which will enable us to move from awareness to evidence-based action. This will help us to rethink how we approach autistic people’s access to work and perhaps drive a wider rethink around how we accommodate everyone in work, as we all think differently with unique strengths, challenges and needs.”

As part of the review, many of the adjustments and initiatives that would benefit autistic people could also benefit a wider group of people who think differently, including those with other neurodevelopmental conditions such as ADHD, dyslexia and dyspraxia.

Storm Arwen: Learning the Lessons

New processes in place one year on

Organisations across Scotland have put in place a series of measures to protect communities from the effects of severe weather ahead of winter.

It follows a review of the Storm Arwen response published in January 2022, which set out 15 recommendations for the Scottish Government and its partners.

A report published today updates on progress since then, with a range of improvements put in place ahead of winter. These include:

  • A full winter readiness exercise carried out by emergency responders across every area in Scotland by the end of November
  • A new online learning and training hub to help individuals, community groups and the voluntary sector to prepare, respond and recover from emergencies
  • The development of a new process to monitor and evaluate Scotland’s resilience system annually to identify and resolve issues quickly and effectively
  • Increased integration and engagement with the voluntary sector, and expansion of local directories of assets and capabilities to support resilience activity

Cabinet Secretary for Justice and Veterans, Keith Brown, said: “The Scottish Government committed to a full review of the circumstances of Storm Arwen, and this report demonstrates clearly the range of work that is underway to ensure that lessons are learned. 

“Our responder community, including our blue light services and our local authorities, will put these recommendations in place and we will support them to ensure our resilience arrangements continue to strengthen to protect communities.”

Chair of the Scottish Resilience Partnership Jim Savege said: “Responders have worked hard through the year, reviewing the risks we need to be prepared for, planning and exercising and making sure we are as prepared as we all can be for any future events and incidents we may have to respond to.

“More than ever, emergency services have considered wider risks that may be realised, and the growing reality of having to deal with concurrent risks and incidents.

“Significant additional work has been invested this year into working with voluntary organisations and communities to ensure their resilience and their ability to deal with incidents has been enhanced. Community and business resilience are the bedrock upon which emergency services work and respond.

“The SRP is grateful for all of the work that so many colleagues have invested in ensuring we are as prepared as we can be for the winter ahead.”

Scotland to modernise breast screening services

A major review of Scotland’s breast screening programme which makes 17 recommendations to strengthen and improve it has been published.  

The report recommends ways to make the breast screening programme more accessible, resilient and sustainable, to drive improvements and build upon successful delivery of services.

These include developing a single programme-wide workforce plan that focuses on role development and redesign, training capacity, leadership for major developments which will help to automate aspects of activity, and benchmarked staffing levels.

It also recommends digital initiatives, including exploring the potential for adoption of Artificial Intelligence in breast screening mammography.

A new Breast Screening Modernisation Programme Board, chaired by Dr Marzi Davies, will take forward the recommendations from the report as well as considering additional ways to modernise the service.

Separate to the modernisation work, the Scottish Breast Screening Programme will see those aged 71 years and over being able to opt to self-refer for appointments once again from autumn 2022, in a phased way which won’t impact on the main screening programme.

Public Health Minister Maree Todd said: “I welcome this report and I am very grateful for the work that went into it while our NHS faced immense pressures in responding to the pandemic.

“We accept all of the recommendations, many of which are already being progressed, such as reinstating self-referral services for those aged 71 years and over, and others that will require careful consideration and planning. 

“It sets out a number of key learning points and opportunities for improving how we do things, and while it was commissioned pre-COVID-19, it’s important to note that the breast screening programme is still recovering from the impacts of the pandemic.

Among our immediate priorities is ensuring that there is sufficient capacity for women aged between 50-70, the recommended screening population, to be invited for screening every three years.   

“I’m pleased Dr Davies has agreed to chair the breast screening modernisation programme to drive forward key ambitions.”

Breast Screening Modernisation Programme chair Dr Marzi Davies said: “The publication of this review and the establishment of the Breast Screening Modernisation Board represent an exciting opportunity to ensure resilience and deliver a sustainable, more person-centred breast screening programme in Scotland.

“I’m privileged to have been asked to lead this work, which will drive improvements in a number of areas and build upon an already high-quality and effective service.”

Renaissance Care internal review

The leading Scottish care home group is undertaking a full review of culture across the organisation after two years of care staff fighting at the front line against the pandemic 

Leading Scottish care home group, Renaissance Care, has implemented a full review with its staff across each of its 16 homes to overhaul the traditional operations across the care home sector. 

Following interviews with staff across all levels, the group, which employs 1,200 people across the country, is reviewing the culture, working practice, and its health and wellbeing offering across the board, as it responds to rising resignations of care staff across the industry on the back of the pandemic. 

Staff across the homes will now be offered a range of new benefits including flexible working, a pay review across all roles, and a health and wellbeing package. 

In response to feedback around long shifts within the care sector, which have historically been 12 hour shifts as industry standard, Renaissance Care will now offer staff a flexible working pattern based on their individual requirements.

The move means that those who want to change shifts around childcare commitments, or want to cut down on long shift times can do so, while office staff will have the option to move to a four-day working week. 

The group will also implement a minimum 5% pay increase for all staff and has committed to becoming a Scottish Living Wage Employer.

 

In line with the review, the care group is also undergoing a project to promote inclusivity and security among its workforce.

It has committed to supplying sanitary items for female staff in all of its facilities, as well as becoming a menopause-friendly workplace with plans to roll out training for staff later this year, and is ensuring an inclusive environment for LGBTQ+ staff and residents with an understanding that identities can be complex. 

The home will also introduce a health and wellbeing package which includes free access to danceSing for all staff members – encouraging health and wellbeing through fitness classes with a saving of £400 per year for each individual. It is also to invest in upgrades to the staff rooms in each home to ensure its care teams have a space that promotes a positive culture throughout shifts. 

In addition, the care home operator is currently investing £500k on its operational management and accounting systems to improve administrative processing for all staff as it responds to feedback about time spent on paperwork throughout shifts. 

Louise Barnett, managing director at Renaissance Care, said: “It is absolutely clear that staff retention and recruitment across the care industry is a massive issue on the back of the pandemic. It comes as no shock that staff, who have had an incredibly difficult two years looking after our most vulnerable in society, would consider changing careers.  

“For most organisations, people are at the heart of the business, but within the care sector it is no exaggeration that staff play the most crucial role in ensuring that elderly residents receive care that goes above and beyond, and we see time and time again the difference that our teams make to peoples’ lives. 

“Operationally, the care sector has always functioned in a certain way but now, as we begin to recover from the pandemic, it is time to turn it on its head and set a high benchmark for what the industry will look like for years to come. We need to modernise the offering for care staff and ensure that they can remain dedicated to delivering the best quality care while having a work life balance that allows a career around family and personal life.”

Robert Kilgour, executive chairman of Renaissance Care, has been a consistent industry voice throughout the pandemic, calling for more support for care homes across the country.

Last year, he spearheaded a group of the country’s leading care home operators who joined forces to help uncover answers to the many questions around the handling of the coronavirus pandemic in Scotland.

Whistleblowing: Council has more work to do, says review

Suzanne Tanner makes FIFTY recommendations for improvement

The findings of an independent review into the whistleblowing and wider organisational culture at the City of Edinburgh Council have been published.

The review was commissioned by councillors in October 2020, with Susanne Tanner QC appointed as independent chair. As with the inquiry into the conduct of the late Sean Bell, published last month, she has been assisted throughout by well-respected law firm, Pinsent Masons.

In her report, which councillors will consider at a meeting next Thursday (16 December), Ms Tanner QC highlights ‘considerable strides’ taken to improve the Council’s whistleblowing and organisational culture since 2014 but also finds that significant work remains to be done, setting out 50 recommendations for further improvements and positive change.

If accepted by councillors next week, Ms Tanner QC’s findings will form the basis of an action plan to be drawn up by the Chief Executive for consideration by councillors in February 2022.

Chief Executive Andrew Kerr said: “I want to thank all those who took the time to contribute to the independent review. I know that, for some, this will have been extremely challenging, based on what they have been through, and I want to pay tribute to their courage in coming forward.

“I also want to thank Ms Tanner QC and the team at Pinsent Masons for their forensic approach to their work and the sensitivity and care with which they treated contributors.”

Council Leader Cllr Adam McVey said: “We owe it to our colleagues and to the public to continue to drive improvements and make sure the culture of the Council is the best it possibly can be.

“I’m grateful to the independent review team for outlining points that need further work and for setting out strong and thorough recommendations on how to sustain the positive path the Council is on. The report highlights the significant progress and improvements made to the Council’s whistleblowing culture in recent years and this should give all of us encouragement that further improvement can be achieved.

“It will take a lot of work to implement these independent, robust and constructive recommendations, but I’m confident these will be adopted in full by Councillors and delivered by the Chief Executive and wider management team to make sure the Council is in the very best position it can be to support our colleagues and deliver the best services for the people of Edinburgh.”

Depute Leader Cllr Cammy Day said: “It was crucial that our colleagues – both past and present – and others with a connection to the Council, felt empowered to come forward and share their views and we went to great lengths to ensure they were aware of the process and how to get involved.

“This resulted in a greater than expected response to Ms Tanner’s call for evidence and, ultimately, supported what is a detailed and thorough examination of our culture.

“We will now carefully consider the findings and recommendations and agree an action plan for how best to take these forward.”
