Housing Bill measure to help tenants stay in their homes

Long term rent controls would help keep homes affordable for tenants in future, under new legislation to create a fairer, better regulated rented sector.

The Housing (Scotland) Bill, introduced to Parliament last week, sets out how close working with councils will ensure rent controls are tailored to the local needs of tenants and landlords in different parts of the country. 

Publication of the Bill, which will be scrutinised and voted on by MSPs, comes as temporary changes to the way rents are decided, through adjudication, come into force. From 1 April, these changes will ensure people are protected from very steep rent rises, following the end of the rent cap. Proposed rent increases after this date will still need to give three months’ notice.

Tenants’ Rights Minister Patrick Harvie said: “Scotland has led the way within the UK in supporting and strengthening the rights of people who rent their homes.

“The Housing Bill sets out our next steps on the path towards a fairer, well-regulated private rented sector, which is good for both tenants and landlords and encourages investment. 

“While the Parliament prepares to consider this legislation, we are also taking steps to support tenants with the pressures they are facing here and now.

“Our temporary changes to the ways that rents are decided will come into place from April 1 – to protect people who may be facing very steep increases as the temporary rent cap comes to the end of its final extension period.”

GREENER HOMES ON GRANTON WATERFRONT

The Scottish Government has published their consultation paper on planned Heat in Buildings legislation which sets out a path for how best to deliver greener, warmer homes for Scotland. 

The Minister for Zero Carbon Buildings, Active Travel and Tenant’s Rights, Patrick Harvie, recently visited Granton to see heat networks being set up for the new developments on the Waterfront. 

The systems and homes being built in Granton are examples of what could be rolled out across Scotland – greener energy, lower bills and no fossil fuels. 

Green Councillor for Forth Ward, Kayleigh O’Neill said: “This is another major milestone in the Granton Waterfront project. Over £1 billion has gone into helping a community become well connected and no longer reliant on fossil fuels. This is a massive step towards tacking climate change and transitioning the city, and country, to net-zero.” 

Cllr. O’Neill added: “Over the next ten years we will also see more affordable housing being built and care taken towards our urban coastal green spaces. We have to be ambitious and put people and planet first in all future developments.

“This is a once-in-a-lifetime opportunity to transition towards a greener economy. Granton Waterfront will set the standard for sustainable growth and show how we can live without fossil fuels.” 

The consultation will run until 8 March 2024, then responses will be scrutinised and a final decision made on when to publish a Bill in the Scottish Parliament to pass in 2025.

£1m Cycle Share Fund announced

Ahead of the 2023 UCI Cycling World Championships, #ActiveTravel Minister Patrick Harvie announces £1 million Scottish Government investment to support bike share schemes.

The Scottish Government is investing £1 million to support bike share schemes. Delivered by Cycling UK, the Cycle Share Fund will get more people in Scotland cycling, by enabling access to a bike in an affordable, easy and convenient way.

It will enable organisations to purchase cycles and equipment for schemes that provide people with access to a bike that they don’t own. It will support a range of delivery models including loan schemes, subscription services, hire schemes, bike libraries, pool bikes and bike shares.

With support from Cycling UK, organisations who run or wish to run any form of cycle share scheme, including third sector and community organisations, charities, schools and other workplaces, will be eligible to apply for funding.

The fund will tackle barriers to cycling including the upfront costs of buying a bike, uncertainty around choosing the right bike or how to maintain it, or lack of a safe place to store a cycle.

Launching the funding, Minister for Active Travel Patrick Harvie visited Bike for Good in the west end of Glasgow, to learn more about their existing non-ownership pilot ‘SWITCH UP’.

Minister for Active Travel Patrick Harvie said: “I’m pleased to announce the Scottish Government investment of £1 million to support and develop cycle access schemes across the country.

“With the eyes of the world on Scotland for the first ever UCI 2023 Cycling World Championships – this investment demonstrates our commitment to removing barriers to cycling by expanding access – helping to keep the wheels in motion for everyday cycling after the event concludes.

“For our health, wellbeing and environment – we’re committed to building an active nation and making it easier for people to walk, wheel and cycle for shorter everyday trips.

“That’s why the Scottish Government has committed to spend at least £320 million, or 10% of the total transport budget, on active travel by 2024-25. Through this, we can bring about more projects like the one Bike for Good in Glasgow is expertly offering. Coupled with further investment in infrastructure, we will transform our communities to support the revolution in active travel that we need to see.”

Delivered by Cycling UK in Scotland, the #CycleShareFund will get more people in Scotland cycling through organisations like Bike for Good Glasgow.

Plans to extend protections for tenants

Emergency measures to protect tenants during the cost of living crisis, including the private rent cap and additional eviction protections, will be extended for a further six months if approved by Parliament.

Tenants’ Rights Minister Patrick Harvie has confirmed proposals to keep the Cost of Living (Tenant Protection) Act measures in place until 31 March 2024 at the latest. This would mean:

  • Most in-tenancy private rent increases would continue to be capped at 3%
  • Alternatively, private landlords could apply for increases of up to 6% to help cover certain increases in costs in a specified time period where these costs can be evidenced
  • Enforcement of evictions would continue to be paused for six months for most tenants, except in a number of specified circumstances
  • Increased damages for unlawful evictions of up to 36 months’ worth of rent would continue to be applicable

Social rented sector tenants are protected by the voluntary agreement reached with social landlords on below-inflation rent increases for this financial year.

Mr Harvie said: “As the cost of living crisis continues, these measures are giving important support to tenants, providing them with much-needed stability in their housing costs and additional eviction protections.

“As the social housing sector have agreed their rents in consultation with their tenants, the focus of this temporary legislation is on providing private renters with similar protection. We know some landlords are impacted by rising costs too.

“The option of increasing rents by 6% in specified circumstances ensures landlords who may be impacted by the cost of living crisis can recover some increased costs associated with their let property.

“The final date of 31 March 2024 would be as long as the rent cap and eviction protections could run if approved by Parliament. The necessity of these measures is being kept under review and we will continue to assess whether they remain justified, balanced and proportionate based on the financial pressures rented households and landlords are facing.

“We are also looking at how to transition out of the emergency measures, and we continue to listen to and work hard with stakeholders to develop and deliver rental sector reform.”

Support for people living in Edinburgh to tackle energy bills and fuel poverty

There are now an estimated 860,000 fuel-poor households in Scotland following the latest increase in energy bills on 1 October

As more and more people across the country continue to worry about the cost of living, Zero Carbon Buildings Minister Patrick Harvie wants people living in Edinburgh to know that free impartial advice and financial support is available to help make home energy improvements.

Home Energy Scotland’s ‘Warmer Homes Scotland’ programme could provide funding of up to £5,000 to help support homeowners in Edinburgh to make their homes warmer, greener and more efficient to heat. This latest Scottish Government campaign aims to raise awareness of the support available to tackle energy bills and fuel poverty. 

Commenting on the launch of the Home Energy Scotland 2022/23 campaign, Zero Carbon Buildings Minister Patrick Harvie said: “Many people across the country including Edinburgh continue to worry about the cost of living crisis and the big rise in energy bills caused by surging gas prices.  

“Our latest estimates indicate that there are around 860,000 fuel-poor households in Scotland, of which 600,000 will experience extreme fuel poverty, following the latest increase in energy bills on 1 October. 

“We are making sure that anyone in Edinburgh worried about or struggling to pay their energy bills can get the right support and advice.  

“Our Home Energy Scotland service, delivered by the Energy Saving Trust, provides free and impartial advice, support and funding to help households in Scotland to better insulate their homes saving on energy costs while at the same time reducing their impact on the environment.  

“The Home Energy Scotland team are on hand to advise how our Warmer Homes Scotland programme could provide funding of up to £5,000 to help make your home warmer, greener and more efficient to heat.  

“A range of measures – big and small – to improve energy efficiency around your home are likely to be available, and I’d urge all households to find out more and get advice as soon as possible.”
