Edinburgh becomes Scotland’s first local authority to enforce against pavement parking

Edinburgh became the first Scottish local authority to enforce against parking on pavements, parking at pedestrian crossing points and double parking yesterday (Monday 29 January).

Parking attendants have begun monitoring streets across the city, along with existing duties. Anyone found to be contravening the new rules could be subject to a £100 fine, reduced to £50 if paid within the first 14 days.

Transport and Environment Convener Councillor Scott Arthur joined parking attendants yesterday to see the impact of the changes. He also met representatives from Guide Dogs Scotland and Living Streets, with whom the Council collaborated to lobby for the introduction of controls in Scotland.

National regulations giving councils the power to enforce the new rules came into effect on 11 December. The change addresses the inconvenience inconsiderate parking causes to all road users, in particular those with mobility issues, visual impairments, and people with pushchairs.

Councillor Scott Arthur, Transport and Environment Convener, said: “We’re leading the way as Scotland’s first local authority to enforce against pavement parking, as well as parking at crossing points and double parking.

“This is a change that we’ve wanted to make for a long time, and I’ve heard from many people who say it will make their day-to-day life much easier. It will make our streets safer for everyone, in particular those with visual impairments or mobility issues, and I’m delighted that reports of pavement parking are already coming down.

“Now the restrictions are in place, we are relying on the public to park safely and considerately, making sure not to block any roads. We’ll continue to monitor streets across the city to make sure the impacts on the wider network are minimal.”

People who have been affected by pavement parking have also welcomed the ban.

Edinburgh-based guide dog owner Elaine MacKenzie said she and guide dog Tessy are often forced out onto the road when their path is blocked by a parked vehicle, putting them in real danger.

Elaine said: “I remember a time when there was a work van parked on the pavement. It was a very busy road but we didn’t have any other option to get past. I had to go on the road to actually get to where I needed to go, and I was terrified.

“Sometimes you’re walking towards traffic or you can be walking with traffic coming from behind you, which is really scary if you can’t see.

“I’m so glad the City of Edinburgh Council are doing something to end pavement parking. The new legislation will make a real difference to my everyday life. It will be one less thing to worry about when I am out and about with Tessy.”

Local parent Euan Reid added:The ban on pavement parking will make a big difference for parents who are using prams in Edinburgh.

“There have been occasions where I have had to use the road to navigate our pram past cars parked on the pavement, this creates an unnecessary risk to parents and their children, and I am pleased that the City of Edinburgh Council have taken action to make the streets safer for everyone.”

Mike Moore, Policy and Campaigns Manager at Guide Dogs Scotland, said:We applaud the City of Edinburgh Council’s swift and decisive action to use its new powers to tackle pavement parking in the city.

“These measures will be a huge help for people with sight loss, who are often discouraged from getting out and about by the fear of badly parked vehicles.

“While pavement parking creates problems for everyone, it is especially dangerous if you have sight loss and can’t see whether traffic is coming towards you.

“Removing the barrier of vehicles blocking the way for pedestrians will make Edinburgh a more accessible city and sets a strong precedent for all local authorities in Scotland to follow.”

David Hunter, Convener of the Living Streets Edinburgh Group, said: “It’s been a long road to getting a ban on pavement parking.

“Living Streets has campaigned for this for well over ten years so it is gratifying to see the day arrive when we should no longer see this kind of anti-social parking. Pavements are for people and cars don’t belong on them.

“We are especially pleased to see the City of Edinburgh Council leading the way by applying the ban to every street, without exception.”

Officers have identified a small number of streets where there is significant pavement parking and have written to these properties to help them prepare for the measures. Now the ban is in place monitoring will continue to ascertain whether any mitigation measures are required to minimise potential negative impacts on the wider road network.

The restrictions will help ensure Edinburgh’s roads and footways are accessible for all, which is central to our vision of an equal, accessible and sustainable city as part of the City Mobility Plan.

The prohibitions first featured in the Transport (Scotland) Act 2019, though the necessary regulations required to support the enforcement and appeals procedures have only recently been finalised by Transport Scotland.

Capital’s pavement parking controls to be introduced in New Year

Preparations are underway to begin enforcement against pavement parking in Edinburgh, following the introduction of new powers by the Scottish Government.

report to Transport and Environment Committee sets out a proposed approach and timescales for enforcing against pavement parking as part of new parking prohibitions being introduced. National regulations are expected to come into force on 11 December and it is proposed that Edinburgh’s enforcement begins in January 2024.

Parking on pavements, at dropped kerbs and double parking can inconvenience all road users, significantly impacting people with mobility issues, parents with pushchairs and older people.

The Council has always supported a ban on pavement parking and has collaborated closely with Living Streets and Guide Dogs Scotland to lobby for the introduction of controls in Scotland. This will help ensure Edinburgh’s roads and footways are accessible for all, which is central to our vision of an equal, accessible and sustainable city as part of the City Mobility Plan.

Councillor Scott Arthur, Transport and Environment Convener, said:Implementing these new parking restrictions is part of our commitment to ensure Edinburgh’s roads and pavements are accessible for all.

“Making sure our footways are kept clear will deliver real benefits for pedestrians and road users, particularly those who are disproportionately affected such as parents with pushchairs, older people and wheelchair users.

“We would expect everyone to adhere to the new prohibitions when the final regulations come into force to guarantee our streets are safer and more user-friendly.”

Stuart Hay, Director, Living Streets Scotland, said: “Edinburgh is taking the right approach to the enforcement of pavement parking, recognising that footways are for people, not parking spaces for cars.

“Exemptions should only be applied in exceptional cases based on evidence, which can only be collected via careful monitoring and consultation. This is the best way to ensure those most affected by blocked pavements, including disabled people, have safe access to our streets.”

Niall Foley, Lead External Affairs Manager at Guide Dogs Scotland, said: “Parking on pavements is a nuisance for everyone, but potentially dangerous if you are a wheelchair user forced onto the road, pushing a buggy, or have sight loss and can’t see traffic coming towards you.

“When cars block the way, it undermines the confidence of people with a vision impairment to get out and about independently.

“We welcome the parking measures being introduced and look forward to working with Edinburgh Council to ensure the pavement parking prohibitions are a success.”

Preparations include the assessment of 5,217 roads by officers as part of the footway parking assessment project. This has helped to identify a small number of streets where significant pavement parking may require mitigation measures to minimise potential negative impacts on the wider road network.

Despite the prohibitions featuring in the Transport (Scotland) Act 2019, the necessary regulations required to support the enforcement and appeals procedures have only recently been finalised by Transport Scotland and are expected to come into effect on 11 December.

Work to complete the necessary changes in Edinburgh will commence as soon as it is confirmed that the new regulations have come into force.  

An awareness campaign, currently being designed by Transport Scotland, is hoped to drive a change in behaviour over the festive period in advance of enforcement beginning. A further Council-run campaign aligned with the national approach is intended once the new prohibitions take effect.

UK Government crackdown on illegal sale of vapes

‘Bold new measures’ to combat rising levels of youth vaping to be announced this week

  • A new ‘illicit vapes enforcement squad’ – backed by £3 million of government funding – to be formed to enforce rules on vaping and tackle illegal sales of vapes to under-18s
  • Call for Evidence also launched to identify opportunities to stop children vaping

The UK Government is expected to unveil tough new measures to combat the illegal sale of vapes to under-18s as part of its plans to reduce smoking and tackle youth vaping in England.

In his speech at Policy Exchange on Tuesday 11 April, Health Minister Neil O’Brien is expected to announce a new ‘illicit vapes enforcement squad’ – backed by £3 million of government funding – to enforce the rules on vaping and tackle illicit vapes and underage sales.

Working across the country, the enforcement squad led by Trading Standards will share knowledge and intelligence across regional networks and local authorities.

It will undertake specific projects such as test purchasing in convenience stores and vape shops. It will also produce guidance to help build regulatory compliance, and will have the power to remove illegal products from shops and at our borders.

The minister is also expected to announce the launch of a Call for Evidence to identify opportunities to reduce the number of children accessing and using vapes, while ensuring they remain available as a quit aid for adult smokers.

It will explore topical issues such as the marketing and promotion of vapes and the environmental impact of disposable products.

Health Minister Neil O’Brien said: “Smoking kills, so our priority is to prevent people smoking, and support them to quit. We remain committed to our ambition to be smokefree by 2030.

“However, while vaping is a preferable alternative to smoking for adults, we are concerned about the rise in youth vaping, particularly the increasing use of disposable vaping products.

“The new illicit vapes enforcement squad will work across the country and clamp down on those businesses who sell vapes to children – which is illegal – and get them hooked on nicotine. Our Call for Evidence will also allow us to get a firm understanding of the steps we can take to reduce the number of children accessing and using vapes.”

Smoking prevalence in England in 2021 was 13.0%, the lowest on record, thanks to measures such as doubling duty on cigarettes since 2010 and continued funding to local stop smoking services. In 2021-22, £68 million of funding from the public health grant was spent on stop smoking services by local authorities, and nearly 100,000 people quit with the support of a stop smoking service.

In addition, £35 million was committed to the NHS last year so that all smokers admitted to hospital will be offered NHS-funded tobacco treatment services.

Low Pay Commission: new report on compliance and enforcement of National Minimum Wage

The Low Pay Commission (LPC) has published a report on non-compliance and enforcement of the minimum wage in Leicester’s textiles manufacturers.

Since 2020, multiple agencies have carried out large-scale joint enforcement operations in Leicester, partly in response to persistent reports of exploitation and underpayment. Low Pay Commissioners heard evidence on the forces driving non-compliance and what enforcement bodies have found.

At the heart of this evidence is a disconnect: enforcement bodies have found relatively modest non-compliance in Leicester, while Commissioners spoke to other bodies and individuals who believed non-compliance to be widespread and flagrant.

Today’s report looks at three potential explanations for this disparity.

  • Firstly, on the positive side, recent changes within the textiles industry mean some evidence of underpayment may be historic and so less reflective of current situation.
  • Secondly, the vulnerability of workers means they may be reluctant to provide information.
  • Thirdly, there remains potential for employers to conceal underpayment from investigating bodies.

Bryan Sanderson, Chair of the LPC, said: “The evidence we heard from workers in Leicester was striking. Despite some positive recent progress, job insecurity, a poisonous workplace culture and low expectations leave workers trapped in poor-quality jobs and vulnerable to exploitation.

“These same factors mean they are unlikely to report abuses, which undermines efforts to enforce workers’ rights.

“The case of Leicester is not unique. Across the UK, workers in precarious positions face the same obstacles, with the same consequences for enforcement. The problem demands comprehensive action, including to give these workers greater security over their hours and incomes.”

Low Pay Commissioners make several recommendations for Government:

  • The process for reporting abuses does not work for the most vulnerable low-paid workers; but it also fails to engage the third-party bodies whom workers may trust more, or wider industry networks. Commissioners recommend HMRC looks at ways to address these problems.
  • There is an ‘information gap’ between what industry and civil society groups think they have reported to official bodies, and what those official bodies are able to share and act on. A forthcoming official review of enforcement operations in Leicester should take into account evidence from both sides of this gap.
  • Insecure work and uncertainty over hours and incomes are central to the vulnerability of workers to exploitation. Low Pay Commissioners urge the Government to take action on the measures recommended by the Commission in 2018 to address these issues.

Vaccine certification enforcement gets underway across Scotland

The Coronavirus vaccine certification scheme will become subject to enforcement from today meaning higher risk venues and events affected must verify customers are fully vaccinated, or otherwise exempt, before entry.

The grace period from the October 1st launch date, allowing venues to test and trial the scheme without facing enforcement action, has now expired.

People attending a range of late night venues and larger indoor and outdoor live events, such as music festivals or large sporting events, will be required to show staff proof they are fully vaccinated or are otherwise exempt. This can be done via the NHS Scotland Covid Status App on their mobile device or using the paper certificate.

Health Secretary Humza Yousaf said: “The grace period allowed venues and businesses affected more than two weeks to test the scheme in practice and make suitable arrangements. It has also provided the Government with helpful feedback from the sectors affected and we continue to liaise with them going forward.

“This is a very limited scheme and we hope this will allow businesses to remain open and prevent any further restrictions as we head into autumn and winter. This virus has not gone away and vaccine certification will have a role to play in keeping transmission under control as part of a wider package of measures. It adds a further layer of protection in certain higher risk settings.

“I also want to ensure that as many people get vaccinated as possible and particularly to increase uptake in the younger age cohort, so anything to incentivise that is helpful.”

Local council officers will be responsible for enforcement of the certification scheme which will apply to the person responsible for each premises. Officers will adopt an approach of engaging, explaining and encouraging the responsible person before enforcement options are considered.

Tackling wildlife crime: Operation Wingspan enters final phase

Operation Wingspan, a year-long campaign to tackle wildlife crime, working with partners, including the Partnership Against Wildlife Crime (PAW) Scotland, has seen considerable success and is now entering its final phase.

This involves officers working on the persecution of fresh water pearl mussels and tackling all aspects of poaching, including hare coursing. As with previous phases, it will involve a combination of enforcement action and education.

Overall, the campaign has involved officers engaging with a number of organisations, including the agricultural community, ranger services, land managers and game keepers with the aim of educating the wider public and encouraging them to report wildlife crime to the police.

Detective Sergeant Billy Telford, Police Scotland’s Wildlife Crime Co-ordinator, said: “We have many internationally renowned species that attract thousands of nature lovers and tourists every year to Scotland, but many crimes against wildlife are cruel and barbaric, often involving a painful death.

“From hunting deer, hares or badgers with dogs, to using poisons or snares on protected birds, and protecting one of our lesser known species, the critically endangers freshwater pearl mussel, Operation Wingspan is raising awareness and hopefully encouraging people to come forward and report this kind of crime.”

Operation Wingspan began in October 2020 and Phase One saw officers tackling the trade in endangered species and included visits to over 300 business premises, such as antique dealers, retro shops and pet shops across Scotland to advise owners and provide information about potential contraventions under The Control of Trade in Endangered Species (COTES) 2018 regulations.

It resulted in the seizure and recovery of alligator heads from across the country.

Phase Two tackled badger persecution, working with the charity Scottish Badgers, to highlight that badgers and their setts are protected, that it is an offence to harm or interfere with them and that badger baiting is illegal. Where ongoing risks were identified, action was taken to protect the sett and the badgers.

Phase Three saw officers taking part in a construction conference to outline the responsibilities of developers, highlighting that it is an offence to destroy or damage roosts, as well as engaging with bat groups and visiting vulnerable roosts, ultimately leading to people being charged for undertaking development that threatened the welfare of bats.

In Phase Four concentrated on raptor persecution. Officers have carried out a number of activities, including patrols of vulnerable nesting sites, warrants executed in relation to wildlife crime and a social media campaign with an educational video that was produced in collaboration with the RSPB.

Detective Chief Superintendent Laura McLuckie said: “Reports of wildlife crime doubled during lockdown and Police Scotland is dedicated to working closely with a wide range of partner organisations to reduce the harm to species targeted by criminals and the communities who rely on them for employment and tourism across Scotland.

“Tackling wildlife crime is not just about enforcement, it is also about working with partners and raising public awareness to prevent it happening. Indeed, the public has an important role in helping up to investigate reports of wildlife crime and I would urge anyone with concerns or who suspect a wildlife crime has been committed to contact us on 101, and if it is an emergency to call 999.”

No joke as litter louts are hit by higher fines

People dropping litter or flytipping in Scotland risk being hit with higher financial penalties from today (1 April). 

The rise in Fixed Penalty Notices will see those caught littering face an £80 penalty; while those flytipping could be £200 worse off. The move follows a public consultation, which supported tougher penalties for anyone who doesn’t bin their waste or damages our environment by flytipping.

The penalty increase comes ahead of the Scottish Government’s National Litter Strategy – the first since devolution, which will be published later this year alongside the Scottish Marine Litter Strategy.

Environment Secretary Richard Lochhead said: “Scotland’s natural environment is one of our greatest assets and we must do everything we can to keep it clean and litter-free. It is easy to do the right thing and put your litter in the bin – there really is no excuse for littering.

“Tackling litter and flytipping costs us a staggering £78 million every year. It’s impacting our economy, looks terrible and in some cases is affecting public health – none of us wants to see a litter-strewn environment; be it rural or urban. It’s up to all of us to take responsibility for this problem and I’d encourage everyone in Scotland to take their litter home, recycle it or find a litter bin.”

Cllr Stephen Hagan, COSLA’s Development, Economy and Sustainability Spokesperson commented: “Litter and its effects have significant costs to both communities and councils. Local authorities are committed to working with their communities and partners to reduce the negative impacts of litter and flytipping, and fixed penalty notices are one of a number of ways in which behaviour change can be encouraged.

“The increase from a £50 to £80 penalty for littering had strong support through the National Litter Strategy consultation and councils will seek only to use this increased financial penalty when other avenues of education and prevention have failed to stop those individuals who not only flout the law but also the efforts of the wider community to keep Scotland clean, tidy and litter-free.”
