UK Covid-19 Inquiry comes to Edinburgh

The UK Covid-19 Inquiry’s Module 2A hearings begin in Scotland today (Tuesday 16 January 2024). The hearings are an important stage in the Inquiry’s investigation into decision making and governance in each nation of the UK.

Members of the public are welcome to attend the hearings in Edinburgh or watch them online through the Inquiry website.

Module 2A, ‘Core UK decision-making and political governance – Scotland’, will look into core political and administrative governance and decision-making. It will include the initial response, devolved government decision making, political and civil service performance as well as the effectiveness of relationships with the UK government and local and voluntary sectors.

The Inquiry is also encouraging people in Scotland to share their pandemic experience so we can truly understand the human impact and learn lessons from it.

Standing next to Scotland’s memorial dedicated to NHS staff who worked through the pandemic – the award-winning ‘Your Next Breath’ – Inquiry Secretary, Ben Connah, said he was excited that the Inquiry’s hearings are soon to begin in the Scottish capital:

“It’s the start of the UK Covid-19 Inquiry’s public hearings here in Scotland. We will be holding three weeks of hearings at the International Conference Centre in Edinburgh. People in Scotland will have the opportunity to hear from politicians, advisers and scientists who were crucial to the decision-making.

“This is a UK-wide public inquiry and it’s really important that we visit the places where decisions were taken and where the impact of the pandemic was felt in different ways in different parts of the country.”

Ben also highlighted how the Scottish public can already participate via Every Story Matters, which will support the UK Covid-19 Inquiry’s investigations and help the Chair of the Inquiry make recommendations for the future.

Every Story Matters will provide evidence about the human impact of the pandemic on the UK population. It provides an opportunity for those affected by the pandemic to share their experiences online without the formality of giving evidence or attending a public hearing, as Ben explained.

“The Scottish public can already play their part in the inquiry by logging on to everystorymatters.co.uk and sharing their experience of the pandemic.

“I am really keen that we hear stories from people right across Scotland, from Stranraer to Stornoway, to help us to build a picture of the impact the pandemic had on this beautiful country.”

Joining the Inquiry Secretary in Edinburgh this week is Hussein Patwa, an Aberdeen resident who is visually impaired and registered blind. He described lockdown as “quite tough”.

“Even to this day the pandemic has affected my independence, my ability to get out and about even in my local area. I have also found it has affected my confidence, especially in larger social situations.”

Hussein is also an enthusiastic advocate of Every Story Matters, as he explained: “Telling my story to Every Story Matters has been a cathartic experience for me.

“It has allowed me to reflect on aspects of my experience I hadn’t even thought about, and that in itself was a healing process. I would encourage everyone to share their story on the Every Story Matters website.”

Call for urgent four nations summit on climate change

Scottish and Welsh Ministers press UK Government on new partnership

The Scottish and Welsh governments have written to the UK Government calling for a new four nations summit on reaching net zero, to be chaired by the independent Climate Change Committee.

The call follows the Prime Minister’s speech on climate change last week.

The letter, co-signed by Scotland’s Net Zero Secretary Mairi McAllan and Wales’ Minister for Climate Change Julie James, highlights the weakness of current arrangements for working with the devolved nations and calls for greater UK collaboration in agreeing the pathway towards the UK’s legally-binding net zero targets.

The two governments propose that the summit be chaired by the independent Climate Change Committee, which acts as a statutory adviser to all four nations.

Dear Michael,

This is a joint letter from myself and Julie James, Minister for Climate Change, Welsh Government.

We write to highlight our disappointment in relation to the Prime Minister’s statement last week (20 September) announcing that the UK Government is significantly changing course on key net zero commitments.

Despite the far-reaching implications of the announcements made – with substantial changes in policy that will impact progress in delivering net zero and have profoundly negative implications for the environment and economy across the UK and further affect the UK’s international reputation – there was no prior engagement with the devolved governments. Given that delivery of the climate ambitions of the four nations of the UK are intrinsically linked, this is deeply unsatisfactory.

In addition, almost a week later, it is hugely frustrating that the UK Government has not provided the level of detail required by such significant announcements. We would urge you to provide this immediately to enable devolved governments to fully assess the implications.

Regarding Scotland, the Scottish Government will separately be writing to the UK Government shortly, in more detail, setting out areas in which progress urgently needs to be clarified. Regarding Wales, the Welsh Government has also separately written to the UK Government, seeking further clarity on the impacts of the recent policy changes on Wales.

Tackling the twin crises of climate change and nature loss is one of the most significant challenges facing people and planet this century and all nations of the UK must work in partnership to complete the net zero journey. Delivering progress on net zero requires urgent action and higher ambition from the UK Government on issues reserved to Westminster to complement the action taken under devolved powers. The Climate Change Committee has been clear that action by the UK Government is important for delivery of climate change targets around the UK, just as action in Scotland and Wales is crucial to UK targets.

Since last week’s process shows the weakness of current arrangements, we are now urging you to establish a new, mutually respectful partnership, with the aim of developing an agreed four nation approach to net zero in a collaborative manner. We therefore invite you to commit, in the first instance, to a high-level summit for a four nation approach and to agree with us that our statutory advisers, the independent Climate Change Committee, be invited to chair the summit.

We are also copying in Katrina Godfrey, Permanent Secretary at the Northern Ireland Department of Agriculture, Environment, and Rural Affairs and the Secretary of State at the Department for Energy Security and Net Zero.

UK Health Secretary offers waiting list support to Wales and Scotland

The UK Health and Social Care Secretary has invited the devolved administration for talks to discuss lessons learnt and tackle waiting lists across the UK

The UK Government Health and Social Care Secretary Steve Barclay has written to the devolved administrations inviting them for talks about how all parts of the UK can work together to tackle long-term waiting lists in all parts of the UK.

NHS services across the UK are a devolved matter, but Prime Minister Rishi Sunak has made cutting waiting lists a priority across the UK. Although approaches taken across England, Scotland, Wales and Northern Ireland share many common features, significant variations in outcomes exist.

In Wales, more than 73,000 people are waiting over 77 weeks for treatment, and at least 21,600 people are waiting over 78 weeks for an outpatient, day case or inpatient appointment in Scotland. In England, waiting times for patients over 78 weeks have been virtually eliminated.

The Secretary of State is inviting health ministers from the devolved administrations to discuss what lessons can be learnt from the different approaches taken.

In England for example, NHS patients are offered a choice of provider at GP referral – NHS or independent sector – provided that it meets NHS costs and standards. And from October we will proactively notify patients waiting over 40 weeks for treatment of their right to choose to be treated elsewhere.

In his letter, the Secretary of State writes that he would be open to requests from the devolved administrations to allow patients in Wales and Scotland who are waiting for lengthy periods to choose to be treated at providers in England, NHS or independent sector – building on the current arrangements for cross-border healthcare.

The Secretary of State has also asked UK health ministers to discuss how health data can be made more comparable across the UK. Northern Ireland official counterparts have also been invited to the ministerial meeting.

Health and Social Care Secretary Steve Barclay said: “I hugely value being able to share knowledge and experiences on the joint challenges facing our healthcare systems. I want to support collaboration between our nations to share best practices, improve transparency and provide better accountability for patients.

“This will help to ensure we are joined up when it comes to cutting waiting lists – one of the government’s top five priorities – and will allow us to better work together to improve performance and get patients seen more quickly.”

The letter reads:

Dear Michael and Eluned,

Thank you for a constructive meeting last month.

As you know, the NHS is at the forefront of people’s minds, and the Prime Minister has made cutting waiting lists a priority to ensure people across the UK get the care they need more quickly. We must continue to take steps to support the NHS and reduce waiting times to ensure no part of the UK is left behind. I am therefore concerned by the variation in performance across NHS services.

As we look to address this issue, it is important that the UK Government and Devolved Administrations work together to ensure that no matter where you are in the country, citizens can access vital services quickly.

In England, we are delivering on the actions set out in the NHS’s Elective Recovery Implementation Plan published last February. Our target to virtually eliminate waits of longer than two years by July 2022 was achieved on time and waits for treatment of more than 78 weeks have been virtually eliminated. Although data is not collected on the same basis across the UK, recent figures show more than 73,000 people are waiting over 77 weeks for treatment in Wales, and at least 21,600 people are waiting over 78 weeks for an outpatient, daycase or inpatient appointment in Scotland.

Whilst there are common features across the approaches of England, Wales and Scotland, one area of difference relates to patient choice. In England, patients have the legal right to choose the provider for their first outpatient appointment (at the point of GP referral) for many healthcare services. Patients may choose to be treated free of charge at any provider – NHS or independent sector – provided they meet NHS standards and costs and hold a contract for the provision of services to the NHS. A Patients Association study has found that this can reduce a patient’s waiting time by up to 3 months.

From October, we will proactively notify patients in England who have been waiting over 40 weeks of their right to request to be treated at a different provider if clinically appropriate, again in the NHS or in the independent sector, provided they meet NHS standards and costs, and they hold a contract for the provision of services to the NHS.

The Secretaries of State for Scotland and Wales share my desire to see patients across the UK have the same rights when it comes to accessing treatment. I would therefore be happy to facilitate a Ministerial working group session (with NI official counterparts) to share how we are implementing this choice approach in England, and to share lessons on work across the UK to tackle the elective waiting list. I would also be open to considering any request from you for patients waiting for lengthy periods for treatment in Scotland and Wales to be able to choose from alternate providers in England – NHS or independent sector – in line with the approach we are taking here, and building on the existing arrangements for cross-border healthcare.

I also believe we need to work together to ensure that health data is more comparable across the UK. It is important that all our citizens can understand the performance of the health services they are receiving and that we can learn from what has been tried and tested in one part of the UK to improve services across the country. I welcome the work our respective teams have been doing to improve data comparability, for example through the Office for National Statistics’ work to improve key UK-wide health performance metrics.

I am very keen to see this work progress and ask for your continued support in prioritising this moving forward.

Call for targeted action on soaring energy bills

Chancellor urged not to pass on costs to struggling households

The UK Government is being urged by the devolved governments to fund its cap on energy prices through a windfall tax, not higher borrowing.

In a joint letter to the new Chancellor of the Exchequer Kwasi Kwarteng (below), Deputy First Minister John Swinney is joined by Finance Ministers from Wales and Northern Ireland in calling for more targeted support to those impacted the most by the cost of living crisis.

They express their concern that more action is needed to prevent further hardship for households and businesses and say support “should be funded by targeting the windfall gains in the energy sector rather than passing on the cost through higher borrowing”.

The Finance Ministers also call for additional funding to support vital public services in the face of rising prices, energy costs and wage pressures as devolved settlements are worth considerably less in real terms than last October when they were set.

The joint letter reads:

Dear Kwasi,

We want to jointly congratulate you on your new role as Chancellor of the Exchequer. We are committed to working constructively with you and the new UK Government. A productive working relationship will be essential to tackle the economic crisis facing our citizens, communities and businesses.

We wrote to your predecessor on 15 July outlining our considerable concerns with the worsening economic situation in the UK including the cost crisis, funding for public sector pay and the impact of inflation on the Devolved Governments’ budgets. Our letter has been included as an annex here.

The Prime Minister’s announcement of 8 September limiting increases in energy bills will alleviate some of the anticipated additional pressures on households and businesses. However, it is important to recognise that overall this is an expensive package of measures that does not target support to those who need it most. We are deeply concerned at who will bear the brunt of these costs. Support should be funded by targeting the windfall gains in the energy sector rather than passing the cost to households through higher borrowing.

Looking ahead to your forthcoming fiscal statement, we urge you to focus efforts on those most impacted, not just relying on blanket interventions which do not recognise the scale of hardship particular households are facing.  An extended and targeted support package needs to be provided to help those who, even with the cap, are facing the impossible choice between heating their homes and feeding themselves and their loved ones. Even with the price cap, energy costs are still double what they were last year.

In addition to households, early clarity and additional support is also required for businesses and the third sector, who are facing substantial challenges. The current measures provide businesses with only a temporary respite and little certainty to help them plan for the future. Many organisations would be forced to close if they are not supported.

Ministers in the Devolved Governments have exhausted the options available to us to address the cost crisis, stretching every pound available to us to provide support. The main levers that can make a difference are held by the UK Government and it must now take urgent steps to use these to provide much needed certainty to those suffering hardship and poverty.

The crisis has also resulted in a major squeeze on funding for public services and increases in demand. Additional funding is urgently needed to support our vital public services in the face of rising prices, energy costs and wage pressures, alongside unforeseen pressures. Based on recent inflation and widespread inflationary expectations for the next year or two, our respective three-year spending review settlements are worth considerably, potentially billions, less in real terms than when we received them last October.

Further, Russia’s unprovoked invasion of Ukraine has resulted in many Ukrainians seeking safety across the UK, however it is necessary to increase the funding available to support them here. In particular, there is a lack of parity in the funding available for those arriving under the Ukraine Family Scheme and the Ukraine Sponsorship Scheme, which cannot be right. ‘Thank You Payments’ to host families should also, in line with Lord Harrington’s recommendation, be doubled to ensure that those who have opened their homes to Ukrainians do not lose out financially as a result.

We would welcome early engagement and clarity on planned fiscal events to enable us to set out the implications for the devolved nations and effectively plan our own budgets, which are significantly impacted by UK spending and tax decisions.

Collaborative working between the UK Government and the Devolved Governments in a spirit of mutual respect would be of benefit to all of us.

Given that, now overdue, action is required to tackle the crisis we propose a quadrilateral meeting with the Chief Secretary to the Treasury as soon as possible and in advance of the FISC to agree the immediate steps that must be taken to tackle this issue and support households, businesses and the public sector.

‘Boris, We Need To Talk’: FM urges action to address cost of living crisis

Sturgeon calls for emergency meeting

The First Minister has sought an emergency meeting of the Prime Minister and Heads of devolved Government Council to agree steps to help people in need as a result of the cost of living crisis.

In a letter to the Prime Minister urging the suggested September meeting be brought forward due to a “fast deteriorating” situation the First Minister made her view clear that “many people across the UK simply cannot afford to wait until September for further action to be taken”.

The meeting between leaders of the devolved governments and the UK Government would provide an opportunity to agree actions that can be taken now and formulate a plan of action for the long term. 

The Scottish Government Resilience Room (SGoRR) will convene this week to discuss what steps can be taken to urgently ease the burden on households across Scotland, both now and in the future.

First Minister Nicola Sturgeon said: “While we will continue to take all actions available to us within devolved responsibilities and budgets – the Scottish Government is investing almost £3 billion this year in a range of measures which will help address the cost of living pressures – it is a statement of fact that many of the levers which would make the biggest difference lie with the UK Government.

“It is also the case that only the UK Government can access and make available resources on the scale required. Therefore, actions by devolved governments alone – though important  – will not be enough to meet the unprecedented challenges we face.  

“Action is needed now to address significant gaps in help for households, in particular those on low incomes, who are increasingly vulnerable to the impact of rising household costs.

“However, it is also vital, given further increases to energy bills due to be announced later this month, that a substantial plan be developed now to avert and mitigate what will otherwise be a crisis of unprecedented proportions – a crisis in which many people will be unable to feed themselves and their families or heat their homes.   

“While few will escape some impact of the cost of living crisis, these impacts are not being experienced evenly. That is why the focus must be on providing targeted support to those most adversely impacted, rather than an irresponsible reduction in broad-based taxes which will benefit the relatively better off over those most in need.

“The current crisis requires clear, focused and determined leadership and co-operation to develop and deliver – at pace – a package of interventions to protect those most impacted.”

PM to chair new council with devolved governments

A landmark agreement setting out how the UK and devolved governments will work closely together to deliver for people across the whole of the United Kingdom has been published.

  • Agreement formalises a PM led council, overseeing strengthened working

A landmark agreement setting out how the UK and devolved governments will work closely together to deliver for people across the whole of the United Kingdom was published yesterday (13 January 2022).

The statement was completely overhadowed by the ongoing brouhaha over the Prime Minister’s attendance at lockdown Downing Street parties (or work events!) At time of writing Boris Johnson’s political future remains very much in the balance.

The Intergovernmental Relations (IGR) Review sets out new structures as to how the UK government, Northern Ireland Executive, Scottish Government and Welsh Government will work to deliver for people across the UK – based upon on the existing values of mutual respect, maintaining trust and positive working.

The new system will be a three-tiered structure and will formalise a new council, chaired by the Prime Minister, made up of Heads of the Devolved Governments.

The Prime Minister-led council and Ministerial groups will oversee and strengthen relations between all of the UK’s governments. They will discuss issues that affect people across the UK, particularly where they cut across reserved and devolved policy – or are of shared responsibility.

Strong working and close co-operation has been vital in the response to the COVID-19 pandemic, including coordinating the response to new variants and the rollout of the COVID-19 vaccine. Other examples of joined-up work include investment through Growth Deals and the Afghanistan resettlement programme.

The new structures will be supported by an independent secretariat made up of civil servants seconded from all four governments and will serve the UK government and devolved governments equally.

Beleaguered Prime Minister Boris Johnson said: “When team UK pulls together in common cause, spirit and endeavour we will always be at our very best.

“We’ve shown time and time again the combined strength we have in facing off the shared challenges before us, while also seizing the opportunities ahead for the benefit of the whole United Kingdom.

“Today’s announcements build upon that strength as we all continue to work together to deliver for the British people.”

Minister for Intergovernmental Relations Michael Gove said: “Devolution has empowered communities and resulted in huge benefits across the United Kingdom.

“Today’s landmark agreement will build on the incredible amount of collaboration already taking place between the UK government and the devolved administrations.

“By working together even more effectively, we can better overcome the challenges we face, create greater opportunities and improve people’s lives for the better.”

The new structures are based on a three tier levels for ministerial engagement – alongside a new mechanism for avoiding, escalating and resolving disputes; supported by joint or independent secretariats and based upon consensus.

Sitting below the Prime Minister-chaired council, the second tier will consist of two Interministerial Standing Committees, one chaired by the Minister for Intergovernmental Relations and one on finance.

There will also be the option of time limited committees agreed by consensus to deal with specific issues as required.

The third tier will be made up of Interministerial Groups (IMG) led by individual departments, which will cover a wide range of policy issues within a given minister’s or department’s portfolio.

These will include regular meetings between devolved and UK government ministers on issues such as Health, Transport and Education.

The new structures and processes announced yesterday are underpinned by a reaffirmed set of principles for collaborative working. These are:

  • Maintaining positive and constructive relations, based on mutual respect for the responsibilities of the governments and their shared role in governance of the UK
  • Building and maintaining trust, based on effective communication
  • Sharing information and respecting confidentiality
  • Promoting understanding of, and accountability for, their intergovernmental activity
  • Resolving disputes according to a clear and agreed process

The new structures create a ‘more equal, transparent and accountable system to support collaboration and information sharing between the UK government and the devolved governments and continue to deliver for citizens across the UK‘.

Scottish Secretary Alister Jack said: “Scotland has two governments, and people want to see them continue to work together to tackle covid and drive our recovery.

“Throughout the pandemic, the Scottish and UK governments have worked closely together, to keep people safe, protect public services, and support businesses and jobs in Scotland.

“This important agreement will build on that and help strengthen cooperation further – as we work together to deliver the priorities of people in Scotland on jobs, prosperity and economic recovery.

“It also reflects the increased powers of the Scottish Parliament since 2016 and the UK’s vote to leave the EU.”

Secretary of State for Wales Simon Hart said: “People in Wales want to see politicians working together to defeat the pandemic and focus on our recovery and throughout the past two years the UK government has worked with the Welsh Government more closely and productively than ever.

“This agreement will strengthen these relationships still further as we work together to deliver the priorities of the people of Wales like jobs, prosperity and economic recovery.”

Secretary of State for Northern Ireland Brandon Lewis said: “Today’s agreement will enhance the positive working relationship between the UK government and the Northern Ireland Executive, to the benefit of everyone in Northern Ireland.

“By ensuring that we work together in the best way possible, we will build on the fantastic collaboration which has stood us in good stead as we continue to deliver together for local people.”

So the PM will chair the new council with devolved governments – but will Boris Johnson still be that Prime Minister, or is the party over? The picture may perhaps become clearer early next week.
